Colangelo, Manager Workers * Compensation Sherwin-Williams Company 101 Prospect Avenue, N.W. Cleveland, Ohio 44115-1075 RE * Dear Tony: REDACTED Kenneth A. Lexier, Esquire, an attorney with the law firm representing recently asked for the calculations that form the basis of Sherwin-Williams' claim that owes Sherwin-Williams money due to an overpayment in long term disability benefits/workers' compensation benefits. Attorney Lexier will want to know whether or not there is contractual language in the long term disability policy stating that the benefits paid to may not exceed the $2,043.25 that he received pursuant to the long term disability policy. That is, does the long term disability insurance policy permit to receive workers' compensation benefits in addition to the long term disability benefits without "prejudice" or is required to repay the long term disability carrier in an amount equal to the workers' compensation benefits paid out? Who is the long term disability insurance carrier? Is Sherwin-Williams self-insured? Thank you for your assistance. The calculations and information will be most helpful in assisting us to resolve this matter. Very truly yours. Richard N. Hewes, Esquire RNH/asb N40259 0007-S WP-005803016 CONFIDENTIAL
