At the time you were in my office you raised a question about the use of information obtained in such an examination in the trial of this matter if such becomes neces sary. The Railway Company advised me that they would not want to agree not to use Drs.sycavlem or Freyhof as witnesses if they thought it necessary in later litigation. In other words, they are simply attempting to find out Wheeler's exact physical condition and if It would become necessary to present thiB Information to the Court they are of the opinion that such information should, of course, be available.
