In accordance with t general and special conditions as specified in the attached permit you are hereby authorized to treat, store and dispose of designated hazardous substances. The Waste Management and Enforcement Programs has requested authorization from the Federal Environmental Protection Agency to operate a Hazardous Waste Program pursuant to the provisions of the Federal Resource Conservation and Recovery Act (RCRA). Once delegation is received, a permit issued under Section 8-1413.2 of the Natural Resources Article will constitute a permit under the Federal Act. Efforts will be taken to keep the Maryland program for hazardous waste control compatible with the Federal program. This permit fee for this Facility as specified in Regulation 08.05.05.10B has been calculated to be $1,503.90. This permit fee must be submitted in its entirety within 30 days of the effective date of the permit or in quarterly installments of $377.23. Permittee is authorized to operate and/or maintain a Facility as defined in Section 8-1413.2 of the Natural Resources Article (1974 volume as amended) as described in an application for a permit and other supportive information submitted.to the Waste Management and Enforcement Programs (WMEP) for consideration. Any deviation from the information submitted, or modification of the facility itself shall be reported in writing to the WMEP wno shall determine if modification of the permit is required. B. Authorized DHS The permittee is authorized to treat approximately 750,000 gallons per day of process waste water. Approximately 825.0 tons of sludge (Class III DHS) are generated per year. The permittee is authorized to remove all waste sulfones and contaminated soils from an on-site disposal site. C. Manifest All DHS transported from the site must be accompanied by a manifest in accordance with COMAR 08.05.05.13. D. Reporting A report of the weights of generated sludges and incinerated waste sulfones shall be submitted to the WMEP as per general condition II.A. E. Schedule of Compliance 1. Within 60 days of issuance the permittee will submit to the WMEP a Compliance Schedule for the removal of waste sulfones and contaminated soils from the current disposal area. If disapproved the permittee shall submit an amended Compliance Schedule within 30<days of disapproval. 2. To assure the integrity of the API Separator and the neutrali zation basins, within 60 days of issuance the permittee shall submit a groundwater monitoring plan for approval addressing the following items: a. Groundwater monitoring well location, construction and design; b. Sampling schedule and methods; c. Chemical species to be monitored and analytical methods. The permittee shall implement the oroundwater monitoring program within 90 days of approval. YEV-l73483 Permit Mo. A005 Pane No. 3 II. General Conditions A. Monitoring and Reporting 1. Renresentative Sampling Samples and measurements taken as required herein shall be taken at such times as to be representative of the environmental effects of facility operations during the specified monitoring periods, specifically with respect to ground and/or surface water effects, or air emissions. 2. Reporting-Monitoring Results Submitted Quarterly Unless otherwise specified in the special conditions for this permit, the monitoring results obtained during the previous quarter shall be summarized on a Monitoring Report Form provided by VMEP for each calendar month of the reporting quarter. These forms and other records required shall be submitted to WMEP, postmarked no later than the 28th day of the month following the end of the reporting period. Reporting periods shall end on the last day of the following months: March, June, September and December. The first reporting period ends December 28, 1980. Manifest copies shall be submitted within 15 days. Sampling and Analysis Methods The analytical and sampling methods used for water analyses shall conform to test procedures for the analysis of pollutants as identified in Test Methods for the Evaluation of Solid Waste Physical/Chemical Methods FPA SW-846, 1980. 4. Data Recording Requirements For each measurement or sample taken pursuant to the require ments of this permit, the permittee shall record the following information: 1. The exact place, date, and time of sampling; 2. The elevation of the water table at the time of sampling (nroundwater sampling only); 173484 II. General Conditions Permit No. A005 Paae No. 4 4. Data Recording Requirements (cont'd) 3. The dates the analyses were performed; * 4. The persons who performed the analyses; 5. The analytical techniques or methods used; and 6. The results of all required analyses. 5. Additional Monitoring by Permittee If the permittee monitors any pollutant at the locations designated herein more frequently than required by this permit, using approved analytical methods as specified above, the results of such monitoring, including the Increased frequency shall be Included in the calculation and reporting of the values reouired in the Monitoring Report Form. 6. Records Retention All records and other information resulting from the monitoring, manifest handling or other activities required by this permit, including all records of analyses performed, calibration and maintenance of instrumentation and original recordings from continuous monitoring Instrumentation shall be retained for a minimum of three (3) years. This period may be extended during the course of litigation, or when so requested by WMEP. WMEP may request periodic submission of a summation of this information. B. Operations Manual Required For an existing operation, within three months of the effective date of the permit, the permittee shall develop a manual of operations, specifyina day-to-day operation procedures for the facility, including .contingency plans for spill prevention and control, systems operation and maintenance and other items of concern. The plan shall be submitted to WMEP for review. If disapproved by WMEP, the permittee shall submit a revised operations manual vnthin two weeks of disapproval. The plan shall be implemented by the permittee after approval by WMEP. For proposed facilities, a manual as outlined above shall be prepared by the permittee and approved by WMEP prior to ooeration of the facility. C. Noncomnliance with Operations Manual If for any reason the permittee does not comply with or will be unable to comply with any provisions of the approved operations manual, or immediately upon becoming aware of a spill or loss of 4 VEV-l?*485 Permit No. A005 Pane No.- 5 A II. Noncompliance with Operations Manual (cont'd) DHS, permittee shall immediately notify WMF-P by telephone at 301-269-3348 within 4 hours of becoming aware of such an occurrence, and provide WMEP with the following information in writing within five days of such notification: 1. A description of the noncompliance; 2. Cause of noncompliance; 3. Anticipated time the condition of noncompliance is expected to continue or if such condition has been corrected, the duration of the period of noncompliance; 4. Steps taken by the permittee to bring the facility into compliance with the conditions of this permit; 5. Steps to be taken by the permittee to prevent recurrence of the condition of noncompliance; 6. A description of the accelerated or additional monitoring by the permittee to determine the impact of the noncompliance on the environment and public health. D. Right of Entry 1. To enter upon the permittee's premises where a facility is located or in which any records are required to be kept under the terms and conditions of this permit; 2. To have access to and copy, at reasonable times, any records required to be kept under the terms and conditions of this permit; 3. To inspect, at any reasonable times, the facility, nonitorino equipment or monitoring method required in this permit; 4. To have access to the facility at any reasonable time for the purpose of obtaining samples, drilling test wells, measurino volumes and kinds of substances received and discharoed. Permit Mo. Transfer of Ownership or Control of Facilities In the event of any change in control or ownership of the facility the permittee shall notify, in writing, the succeeding owner or controller of the existence of this permit and any outstanding violations of this permit. A copy of this notification shall be forwarded to WMEP at least 30 days prior to said change in control or ownership. F. Availability of Reports Except for data determined to be confidential under Maryland Pecula tion 08.05.05.11, all such data shall be available for public inspection at the office of WMEP. G. ' Permit Modification A permit may be modified by WMFP upon the written request of the permittee. H. Permit Modification, Suspension and Revocation A permit may be modified, suspended or revoked by WMFP in the event of a violation of the terms and conditions of the permit, or Federal or State Laws and Regulations and In accordance with the procedures set forth in Maryland State Regulation 08.05.04.12. I. Facility Operation and Maintenance The facility shall be operated in a manner that is consistant with it's design objective, and as a minimum the following is required: 1. The facility shall be secured, and access limited to supervised control points; 2. At least an adequately trained operator or supervisor shall be on-site durina the hours of facility operation; 3. Access to the facility shall be barred durino periods of non-operation; 4. Transporters of DHS to a facility shall surrender a cony of the DHS manifest which shall be retained in the records of the facility; 5. Transfer of the OHS from the transporter to the facility sha1! be conducted in an environmentally safe manner. 6. All equipment necessary for oroner operation, monitoring, or supervision of the facility shall be maintained in a satisfactory condition. VBJ-173487 Permit No. A005 Page No. 7 4 II. General Conditions This permit and the authorization to operate and/or maintain a facility shall expire on midnight . In order to receive authorization to operate and/or maintain a facility beyond the above date of expiration, the permittee shall submit such information, forms, and fees as are required by WMEP no later than days prior to the above date of expiration.
