Papageorge PCB Consensus Rulemaking To break the impasse between environmentalists and utilities industry representatives discussing a consent decree to resolve the challenges in the electrical equipment rule, representatives of the EPA Enforcement Division unexpectedly offered a proposal for a spill-cleanup rule. The EPA proposal included the following provisions: PCB spills shall be cleaned up to background level or 25 ppm, which ever is greater (with some exceptions). A presumption that removal of all visible traces of spilled fluid is adequate cleanup. A presumption that impervious surfaces are adequately cleaned if washed, scrubbed and wiped three times with an appropriate cleaner or solvent. Other issues were subsequently discussed.
