The facility is in a Dairy Outreach Program Area (DOPA). Inspectors met with the dairy consultant, Mr. Jim Wyrick, at the Opening Conference. Inspectors presented their credentials to Mr. Wyrick and informed him that this was an EPA inspection to determine compliance with the facility's TCEQ CAFO Permit (TXG921343), and the Concentrated Animal Feeding Operations (CAFO) requirements as found in the Clean Water Act (CWA). The scope of the inspection was a full compliance evaluation and includes an evaluation of the facility's compliance with its NMP. The sequence for the inspection was an introductory overview conducted during the opening conference, followed by a site review, and review of the NMP and records required per the permit. The inspectors wore boot covers. The consultant for the facility, Mr. Wyrick, participated in the inspection. FACILITY DESCRIPTION The TCEQ CAFO permit (TXG921343) was issued to Van Der Jagt Dairy on 08-12-2024, and it expires on 07-19-2029. The facility permits 1500 milking cows. At the time of the inspection, there were approximately 1430 milking cows. Cows are milked twice daily and housed in covered freestalls between milkings. Freestalls are flushed with recycled wastewater twice daily. The facility borders Chaffin Creek on the western side (Appendix 1, Photo 5). Chaffin Creek is part of the Lake Fork Resevoir watershed. There are three settling basins, one solid separating screen, and two wastewater lagoons located in the production area. The solid separating screen is directly west of the freestalls (Appendix 1, Photo 1). Two concrete lined settling basins follow the screen (Appendix 1, Photo 9). The third settling basin is earthen lined and is west of the freestalls directly before RCS 1 (Appendix 1, Photo 8). RCS (Retention Control Structure) 1 and RCS 2 are located west of the freestalls (Appendix 1, Photos 2 & 6). The facility has 6 LMUs (Land Management Unit): 1 - 56 acres, 2 - 53 acres, 3 - 32 acres, 4 - 56 acres, 5 - 22 acres, 6 - 34 acres. The facility plants coastal Bermudagrass and SG for hay and silage. Wastewater and manure can be applied to all LMUs using center pivots and draghose. Feed commodities stored on site include hay, silage, and seed grain for dairy feed; all are stored under cover. All records were maintained by the consultant and were available for review at the time of the inspection. 2 Section II - OBSERVATIONS Van Der Jagt Dairy Inspection Date 01-22-2026 Lagoon Management: All the RCSs for the facility are designed to receive the production area wastewater runoff done by Jerry Kendall on 06-15-17. RCS 1 required capacity is 17.5 acre/ft with actual capacity of 18.0 acre/ft, RCS 2 required capacity is 33.5 acre/ft with actual capacity of 33.5 acre/ft. All the RCSs have a permeability rating greater than 1 X 10-7. There were no signs of erosion in the embankments and cattle are unable to access the lagoons. All pole markers showed adequate freeboard and are below the 25-yr/24-hr rain event mark. The facility uses gravity flow to route all runoff to RCS (Appendix 1, Photos 1, 3, 4, & 7). Nutrient Management Plan Review: The facility has a Nutrient Management Plan (NMP). The date of the NMP is 07-15-2025 and was prepared by Jim Wyrick. A review of the nutrient application data showed that the facility was keeping appropriate records for the amounts of nitrogen and phosphorus applied to the land application sites at the Van Der Jagt Dairy for both the lagoon process wastewater and manure. The facility also tracks the required annual soil, wastewater, and manure solids nutrient concentrations. LMU 1 was evaluated for agronomic rate applications for 2024, and the facility was land applying below the agronomic rate in line with the NMP. Mortality Management Area: Mortalities are composted on site directly west of the freestalls underneath the solid separating screen within the drainage of RCS 1. (Appendix 1, Photos 2 & 3). Land Management Units: A visual check of LMU 3 and center pivot showed no evidence of leaks or ponding present. Section III - AREAS OF CONCERN The Van Der Jagt Dairy is very well operated and maintained, with good implementation of the best management practices contained within the NMP and CAFO permit. No areas of concern were found at the time of the inspection. Inspectors exited the facility at 10:35 AM.
