Section I - INTRODUCTION
PURPOSE OF THE INSPECTION
EPA HQ Air Enforcement Division, Vehicle and Engine Branch inspectors Victor Aguilar and Mario Jorquera arrived at the Flying Scooter dealership at 4:23 pm on March 08, 2023 for an unannounced inspection. We met with the owner, Mohammed and an employee, Kahled Elessawi at the front desk for the Opening Conference. We presented our credentials to both gentlemen and informed them that this was an EPA inspection to review whether all of the equipment available for sale at the dealership was certified by the EPA for sale in the U.S. The scope of the inspection was a compliance evaluation of the compliance of a random selection of the equipment at the facility. EPA inspector Aguilar gave Mohammed a business card and Inspector Jorquera provided him a small business form.
Mohammed agreed to allow EPA to conduct the requested inspections but excused himself because he said he had to leave on a flight out of the airport. He asked Mr. Elessawi to assist us in any way necessary.
EPA inspectors also met co-owner Firas Abunanbah and traded business cards with him. The email address on his business card is Firas@flyingscooter.com.
FACILITY DESCRIPTION
Facility is a storefront retail outlet for motorsports equipment located in a strip mall. The floor contained display floor space for some 50 or so vehicles, mostly nonroad motorcycles and highway motor scooters, but also including ATVs and UTVs and karts. The dealership had two large rooms for display of vehicles, a back room for repairs and parts storage, a retail sales counter in the back display room and a second-floor office.
Facility appeared to have about 4 employees: The owner/manager three others, including Mr. Elessawi.
Facility operates 6 days a week, about 9 hours each day.
Section II - OBSERVATIONS
At 4:26 pm, the EPA commenced inspections. EPA inspectors Jorquera and Aguilar conducted full inspections on the following units at the dealership:

AGB-36C/DB36 Motorcycle

Inspectors Aguilar and Jorquera also looked at several other vehicles on display for sale to determine whether they had EPA Emission Control Information (ECI) labels, and they all did.
At 5:08 pm, inspectors Aguilar and Jorquera held a Closing Conference with Mr. Kahled Elessawi. EPA inspector Jorquera notified Mr. Elessawi that we found ECI labels on all the motorcycles we inspected, including the emission warranty information.
Mr. Elessawi informed the EPA inspectors that Flying scooters is the major distributor for Apollo bikes and imports directly from the factory. EPA inspector Aguilar informed Mr. Elessawi that some of their dirt bikes look identical to other vendors' "competition" bikes, which do not have to be certified by EPA but do need to meet the requirements of the competition exemption.
Section III - AREAS OF CONCERN
All of the vehicles that EPA examined at this facility had the required EPA Emission Control Information labels and all engine family names checked out with EPA's database. All vehicles inspected had the appropriate emission control components. However, EPA inspectors Aguilar and Jorquera are concerned that other vendors are selling identical equipment without going through the certification process by falsely claiming that their products are sold for competition only.

EPA inspectors Aguilar and Jorquera will investigate the following vendors or equipment:
