By an Act eii'ective May 25. 1955, the administration of the Workmen's Compensation Act is vested in ihc Nebraska Workmen's Compensation Court, consisting of three judges appointed by the Governor for terms of six years each. One judge must be an attorney-at-law, another a repre-entative of employers, and the third a representative of labor affiliated with the American Federation of Labor. Communi cations may be addressed to the Court, at Lincoln, Nebraska. 5. Scope of the Act The Act is divided into five parts. Part I: Compensation by Action at Law--Modifi cation of Remedies (Secs. 48-101 to 48-108). These sections provide a right of recovery by an employee against the employer "When personal injury is caused to an employee by accident arising out of and in the course of his employment, of which the actual or lawful imputed negli gence of the employer is the natural and proximate cause, * * '* unless the employee was guilty of wilful negligence. In such action, the employer is denied the common law de fenses of contributory negligence, negligence of fellow serv ant, and assumed risk. But, if the employer elects to become subject to the pro visions of Part II, and to pay compensation as therein re quired, he is not barred the common law defenses. Occasion to apply this rule would arise only when the employee has re fused to operate under Part II, thus preserving his right of action under Part I. By Sec. 48-105, the above provisions are made applicable to any claim for death of an employee arising under the wrong ful death statutes of Nebraska. Part II: Elective Compensation (Secs. 48-109 to 48-115). Issues informative reports giving practical engi neering measures, medical knowledge, and legal information for preventing industrial diseases and for improving employee health. Counsel of specialists, comprising Foundation's Engineering, Medical and Legal committees, available within reasonable limits. Provides monthly abstracts summarizing current literature on occupational health subjects. This is an important labor-saver for company officials. Further, it insures executives against missing vital new developments. Special problems, surveys, etc., undertaken and supervised for members at cost. Affiliated companies may turn to one central institution for available knowledge in this field. Membership places a company in contact with many other industrial concerns whose experiences with similar problems often prove helpfuL Officers, Committees, Members and Purposes Broad Problems Require Broad Approach Air Hygiene Foundation represents an effort by employers, physicians, and engineers to promote the health of the 15 million workmen in "heavy" industry. Healthful working conditions pay dividends to the employer, it is true. But at the same time they contribute to the welfare of the work man, and indirectly to the welfare of his family and the community. Industrial health, per se, is the concern of the individual employer. Tet basically, employee health prob lems confront all employers through laws and regulations, industrial relations, and public opinion.
