Section I -INTRODUCTION
Coleman Livestock Auction Inspection Date 05/29/2019
PURPOSE OF THE INSPECTION
EPA Region 6 inspector, Juan Ibarra, arrived at the Coleman Livestock Auction at 0951 on 05/29/2019 for an unannounced inspection. I met with the facility Vice-President, Sylvia Edington, at the opening conference. I presented my credentials 1to Ms. Edington as I informed her that this was an EPA inspection to determine the facility's compliance with the Clean Water Act (CWA) and the National Pollutant Discharge Elimination System ( NPDES) Concentrated Animal Feeding Operation (CAFO) regulations. The scope of the inspection was a Compliance Evaluation Inspection. Following the open ing conference, M r. Brown, a facility emplovee accompanied me for the entirety of the inspection and gave me a tour of the site in a company vehicle. The Closing Conference was held with both Mr. and Mrs. Edington where I informed them of the r esults of the inspection and Areas of Concern.
FACILITY DESCRIPTION
Coleman Livest ock Auction is an unpermitted facility that confines an average of approximately 1300 t o 2000 head of cattle on a weekly basis fo:r approximately 2 days per week. The cattle are kept in both _ _ _ _ _o_pen anclc.mt.ered peos_during.l:he-co.ofinement petioci Hay iS-t-Ae-Pr.tmary feefl,aRd the-sale-ec..euFs on - Wednesdays. Approximately 20% of the pens are covered with a metal roof, and the drainage off the roof discharges onto the ground away from the pens. However, the roof drainage commingles with the open lot runoff coming off pens in pooled areas surrounding the facility.
The Coleman Livestock Auction confines and feeds over 1000 head of cattle for two days every week and, therefore, meets the Texas Commission on Environmental Quality' s (TCEQ) definition of a large CAFO. The faci lity does not have a TCEQ CAFO permit, nor does it have any Runoff Control Structures (RCSs), although two areas of manure runoff ponding exist at the east and west ends of the pens . Additionally, lot scrapings are piled around most of the facility and within a pasture located adjacent to the facility.
Section II- OBSERVATIONS
Lack of a TCEQ CAFO Permit Coleman Livestock Auction met the regu Iatory requirements for a large CAFO but did not have a CAFO permit as required by the TCEQ. Most Wt:!eks, according to the owners, the Livestock Auction ran approximately 2000 head of cattle. As an example of how cattle summary records are maintained, I took a photo of the 5/22/2019 summary sale sheet which showed the total number of cattle that went thru the sale barn to be 1272 (See Appendix l Photolog, photo 1).
Lack of Runoff Control Structures (RCSs) Resulting in Runoff Pending There were no properly designed, constructed, operated and maintained RCSs at the site. Cattle pen runoff, comingled with roofed drain runoff, accumulated in two ponded areas. One ponded area was In
