Upon leaving, Spirit Bank requested that Kell remain on its board of directors which Kell declined due to full time employment in Washington, D.C. Spirit would confirm that at no point in Kell's service did he take any action which threatened the bank. I actually just left you a voicemail on your office line because I'm following up on a couple of orders from the FDIC regarding Albert Kelly and his time at SpiritBank. It appears Mr. Kelly has agreed to a consent order and will pay a penalty of $125,000. In addition, he has been issued a prohibition notice from future banking activities from the FDIC. Did Mr. Kelly have to complete any publicly available ethics/background forms to be a senior advisor? If so, can you send me any copies of such forms? 4. Would these FDIC actions preclude Mr. Kelly from continuing in his role as a special advisor to the Administrator or as chairman of the Superfund Task Force.
