Please be advised that I appeared in Rockford on March
22, 1988, at the Winnebago County Courthouse when this case
was set for trial. Present with me were Tim Pearson, who drove up from the Elkhart, Indiana facility, where he now

works and Kevin Tompkins, our current Rockford Branch
Manager. Also present was the claimant,
and
his Attorney Marc Perper of Horowitz, Horowitz & Associates.
Kevin Tompkins was present under subpoena as current
Branch Manager and custodian of the store records. Tim Pearson was present as the Branch Manager for

at the time of the alleged exposures. Tim Pearson had also
left our employ for 1 to 1-1/2 years between the episode and
now and while out of our employ had seen Young socially in
Rockford and had been a witness to his continued smoking,
which he denied doing since 1984.

suprised to see Tim Pearson. He apparently assumed he was no
longer in our employ and had left the state to move
elsewhere. I think Tim's presence sobered both
and
his attorney and helped enable us to make a very reasonable
settlement of $2500.00 or 2.94% man as a whole.
