Inspection Date: February 9, 2023 SECTION I - INTRODUCTION Purpose of the Inspection The purpose of the inspection was to determine compliance with the industrial stormwater requirements under 301 and 402(p) of the Clean Water Act and its implementing regulations found at 40 CFR Part 122.26. The inspection was unannounced and consisted of interviewing facility representatives, written field observations, and taking photographs to document facility conditions during the inspection. Accompanying this report is Appendix A. Aerial Map and Appendix B. Photograph Log. Opening Conference 1) On February 9, 2023, U.S. Environmental Protection Agency (EPA) contractor, PG Environmental, conducted an unpermitted industrial stormwater inspection at York Building Products Co., Inc. (Facility) located in New Freedom, Pennsylvania. Page Cirillo and Taylor Fontaine of PG Environmental (EPA Inspection Team) were accompanied by Heather Dock of PA DEP. Taylor Fontaine presented his credentials to the Facility representative and conducted an opening conference. The EPA Inspection Team explained the purpose of the inspection was to assess the Facility's compliance status under 402(p) of the Clean Water Act and 40 C.F.R. 122.26 et seq. with respect to the PAG-03 National Pollutant Discharge Elimination System (NPDES) General Permit for Discharges of Stormwater Associated with Industrial Activity (Permit). At the time of the inspection, the Facility did not have coverage under the Permit. Weather conditions at the time of the inspection were partly cloudy with temperatures of approximately 40 F. There was no precipitation data available for New Freedom, Pennsylvania. According to precipitation data from Weather Underground1 Harrisburg International Airport received 0.01 inches of precipitation at 8:00 AM the day of the inspection and no precipitation the day before. 2) Credentials presented to: Ron Geiple ______________________________ 3) Facility acknowledged receiving previous outreach materials or correspondence on Permit requirements? Select gravel, pavers, decorative stones, and topsoil are stored in covered storage bays northwest of the main office. Outdoor industrial activities include the storage and loading/unloading of building materials. The main building has an office and vehicle/equipment garage. The 1429 SIC code for Crushed and Broken Stone, Not Elsewhere Classified was provided by the EPA ECHO Facility Finder. Other industrial facilities owned/operated by same business entity? SECTION II - OBSERVATIONS FACILITY OBSERVATIONS Pollutant Sources Observations The Facility receives deliveries of building products and moves products with vehicles Loading/Unloading Operations located at the Facility. Facility vehicles included a compact loader and forklift for moving product at the Facility and loading into customer vehicles. Industrial Manufacturing/ N/A Processing Operations Industrial Machinery & Equipment Storage The Facility vehicles and equipment are stored inside the garage off the back of the main office building (refer to Appendix B, Photographs DSCN1466, DSCN5523, DSCN5529, & DSCN1470). The Facility's building products were stored in covered storage bays, uncovered bins, stockpiles without cover or containment, and on pallets without cover or containment. At the time of the inspection the drums were on top of pallets, empty, and unmarked. The Facility had a covered dumpster outside on the north side of the main office building (refer to Appendix B, Photograph DSCN1466). The EPA Inspection Team observed a waste debris pile without cover or containment at the northern portion of the Facility (refer to Appendix B, Photographs DSCN5532, DSCN5534). Waste Treatment Facilities (e.g., Pretreatment Systems) N/A Fueling Stations/Equipment Maintenance Areas & Cleaning Areas The Facility had a diesel fueling station with an approximately 500-gallon tank within a cinder block retaining wall (refer to Appendix B, Photograph DSCN5500). The EPA Inspection Team did not determine if the diesel tank was single- or double-walled, if there was secondary containment around the tank, or if there was a spill clean up kit nearby. Sediment & Erosion Controls None observed. Spills/Leaks Handling No spill kits or other spill/leak handling supplies were observed. Inspection Date: February 9, 2023 OUTFALL, STORMWATER DISCHARGE & RECEIVING WATER OBSERVATIONS Number and description of each potential Stormwater Discharge Point from the Facility The EPA Inspection Team observed four (4) stormwater discharge points from areas with industrial activity to a ditch that runs along the east side of the Facility (refer to Appendix A, Figure 1). Evidence of pollutants migrating offsite (stains, deposits, ponding) at discharge points, into Receiving Waters or in MS4 Evidence of Non-stormwater Discharges leaving site (authorized or unauthorized) Description of general gradients/slopes onsite, all apparent discharge points, and discharge pathway from Facility to Receiving Water or MS4 (storm drains, channel, swale, ditches, driveway, pipes, & etc.) The EPA Inspection Team observed sediment and aggregate accumulation at discharge points to the ditch running along the east side of the Facility (refer to Appendix B, Photograph DSCN5542, DSCN5543, DSCN5544, DSCN 5549). The EPA Inspection Team observed sediment accumulation in and adjacent to the ditch running along the east side of the Facility (refer to Appendix B, Photographs DSCN1460, DSCN5504, DSCN5540, DSCN5545, DSCN5546, & DSCN5547). The EPA Inspection Team observed vehicle sediment tracking at both the north and south Facility entrances (refer to Appendix B, Photographs DSCN5492, DSCN5499, & DSCN5548). The ditch running along the east side of the Facility utilizes culverts underneath both facility entrances (refer to Appendix B, Photographs DSCN5491, DSCN1458, DSCN5499, & DSCN1460). The Facility is sloped to the southeast. Stormwater runoff from the Facility is directed towards a ditch running along the east side of the Facility. Refer to Appendix A, Figure 1 to see flow direction arrows and discharge points. The Facility property is paved except for the most northern portions of the Facility. The ground was wet from the morning rain. There was evidence of standing or ponding water west of the main office building (refer to Appendix B, Photograph DSCN5519). Deer Creek is located approximately 120 yards south of the Facility. However, a direct connection between the Facility and Deer Creek could not be verified. SECTION III - AREAS OF CONCERN 1) The EPA Inspection Team observed the storage of crushed and broken stone at the Facility, an industrial activity classified under SIC Code 1429 - Crushed and Broken Stone, Not Elsewhere Classified. a. Businesses classified under SIC Code 1429 are regulated under 40 C.F.R. 122.26 for stormwater discharges associated with industrial activity. b. Outdoor industrial activities occurring during the inspection included the storage of building products. Products were in covered storage bays, uncovered bins, stockpiles or stacked blocks. An area of concern would be building materials migrating into the ditch running along the east side of the Facility. c. The Facility did not have coverage under the Permit at the time of the inspection. 2) The EPA Inspection Team observed aggregate stockpiles without cover or containment in the north, west, and east portions of the Facility (refer to Appendix B, Photographs DSCN5508, DSCN1467, DSCN5525, DSCN5528, DSCN5530, DSCN5531, DSCN5535, & DSCN5536). 3) The EPA Inspection Team observed sediment and aggregate accumulation at discharge points to the ditch running along the east side of the Facility (refer to Appendix B, Photograph DSCN5542, DSCN5543, DSCN5544, DSCN 5549). Inspection Date: February 9, 2023 4) The EPA Inspection Team observed sediment accumulation in and adjacent to the ditch running along the east side of the Facility (refer to Appendix B, Photographs DSCN1460, DSCN5504, DSCN5540, DSCN5545, DSCN5546, DSCN5547, & DSCN5548). 5) The EPA Inspection Team observed vehicle sediment tracking at both the north and south Facility entrances (refer to Appendix B, Photographs DSCN5492, DSCN5499, & DSCN5548). SECTION IV - CLOSING CONFERENCE After the Facility walk, the EPA Inspection Team met with the Facility representative from York Building Products Co., Inc. for a closing conference and shared preliminary observations. The EPA Inspection Team reiterated that all preliminary observations discussed were not compliance determinations. Any and all preliminary observations shared were subject to further investigation by the EPA Inspection Team. Additional observations may be contained in this inspection report that were not identified at the time of the closing conference. The inspection concluded at approximately 10:30 AM (EST).
