I May 21, 2003 Page 2 Ladies and Gentlemen: This letter serves as a supplement to our previous letters on the referenced topic dated February 3, 2003 (AR-226-1216), April 4, 2003 (AR-226-1307) and April 11, 2003 (AR-226-1308). Though those letters, we provided information in connection with our concern that there may be a threat to the health of those living in both Ohio and West Virginia whose drinking water is contaminated with C-8 from DuPont's Washington Works Plant in Wood County, West Virginia. Attached to our April 4, 2003, letter were documents relating to DuPont's internal assessment during 1981 of C-8 levels in the blood of its female employees at its Washington Works Plant in Wood County, West Virginia, along with medical conditions of certain children bom to those women. Attached to our February 3,2003, letter was information relating to DuPont's reference in 1987 to an internal "acceptable level" of C-8 in human blood of 0.5 ppm. Attached hereto is a copy of an internal DuPont memorandum referencing the existence of an even lower internal, DuPont "acceptable blood level for female employees" of 0.4 ppm from at least as far back as 1981. (See Exhibit A (EID096478-80))- Very truly yours. Robert A. Bilott RAB/mdm Enclosure cc: R. Edison Hill, Esq. (w/ ends.) Larry A. Winter, Esq. (w/ ends.) Gerald J. Rapien, Esq. (w/ ends.) Mary Dominiak, (USEPA, OPPT) (for inclusion in AR-226) (w/ ends.) (by telecopy and Federal Express) - As a Defendant in a class action lawsuit pending against DuPont in the West Virginia State Court in which we serve as class counsel, and as a Defendant in a prior C-8 case in Federal Court in West Virginia, DuPont has had the right to mark documents produced in such cases as falling under the terms of the Protective Orders in those cases if the documents qualify as "confidential." DuPont did not stamp the copy of the document attached hereto at Exhibit A as "confidential" under the terms of the Protective Orders in either case. l
