Section I - INTRODUCTION
PURPOSE OF THE INSPECTION
This neutral scheme marketplace inspection was conducted pursuant to the Federal, Insecticide, Fungicide, and Rodenticide Act (FIFRA) Section 8, 7 U.S.C. 136f, and Section 9(a), 7 U.S.C. 136g(a), to evaluate compliance with FIFRA and the regulations thereunder.
FACILITY DESCRIPTION
Fiesta Mart, LLC ("Fiesta Mart") is a company incorporated and doing business in the state of Texas. The company specializes in the retail sale of groceries with an emphasis on Hispanic products. According to sources available online, the company earns an estimated $1.7 billion in annual revenue. The company operates at least 65 stores in Texas and Oklahoma, including one located at 2323 Wirt Road, Houston, Texas 77055 ("Fiesta Mart #8"), which was the subject of this inspection. Fiesta Mart, LLC is a subsidiary of Chedraui USA, a company headquartered in Los Angeles, California.
Section II - OBSERVATIONS
I, EPA Inspector Justin Mullenix, and EPA Inspector Sandesh Thapa, arrived at Fiesta Mart #8 on January 13, 2026, at approximately 11:15 AM. We entered the facility and approached an employee who directed us to Ms. Becky Olivo, the Store Director. We explained the purpose of the inspection to Ms. Olivo and proceeded to her office to conduct a pre-inspection meeting. Inspector Thapa and I presented our federal credentials to Ms. Olivo and provided her with a Notice of Inspection (EPA Form 3540-2) which she signed. We were then joined by Ms. Violeta Garcia, Senior Food Safety and Quality Assurance Manager of Chedraui USA. Inspector Thapa and I further discussed the purpose of the inspection with Ms. Olivo and Ms. Garcia before we accompanied them to the sales floor of the facility. We proceeded to the section of the facility where cleaning products and pesticides were being offered for sale. Inspector Thapa and I reviewed the products within that section and discovered the following Product of Concern:
- Clorox Cloro Triple Accin The Product of Concern was identified as being an antimicrobial bleach with a label in Spanish that did not appear to possess an EPA Registration Number or Establishment Number. The Product of Concern was also labeled with stickers characterizing the product in English or Spanish which wholly or partially covered the antimicrobial claims made on the original Spanish label. Inspector Thapa photographed the Product of Concern while I explained its potential compliance issues to Ms. Olivo and Ms. Garcia. Ms. Garcia indicated that the Product of Concern would be removed from the sales floor immediately.
Following the product review, Inspector Thapa and I proceeded back to Ms. Olivo's office to conduct a closing conference. As I began to complete a Receipt for Samples (EPA Form 3540-3), we were joined by Mr. Jose Almanzar, a Category Manager of Fiesta Mart. Mr. Almanzar informed us of his interest in the Product of Concern, as he indicated that he was responsible for the ordering of products of that type for

Fiesta Mart. I inquired if Fiesta Mart could provide records of the distribution or sale of the Product of Concern as well as provide information about its origin. Mr. Almanzar offered to provide additional information about the Product of Concern from his office located at the facility next door (Fiesta Mart's corporate headquarters). Inspector Thapa and I followed Mr. Almanzar to his office where we asked him a series of questions about the Product of Concern. Mr. Almanzar explained that Fiesta Mart normally sources its Clorox products directly from The Clorox Company in the United States but was unable to do so for a period due to a cybersecurity issue affecting the Clorox Company. As a result, a small quantity of Clorox bleach was purchased by Fiesta Mart though another distributor which ended up being the Product of Concern, a form of Clorox bleach intended for sale outside of the United States. I asked Mr. Almanzar if Fiesta Mart was responsible for the stickers found on the Product of Concern. Mr. Almanzar explained that the stickers had been applied to the Product of Concern prior to Fiesta Mart's receipt of it. I asked Mr. Almanzar if he could provide invoices for the Product of Concern from the supplier to Fiesta Mart. I was told that none could be provided; however, Mr. Almanzar provided the name of the supplier. I asked Mr. Almanzar if he could provide Fiesta Mart's sales records associated with the Product of Concern. Mr. Almanzar agreed and compiled the data into a spreadsheet which he then provided to me via email. Following the meeting with Mr. Almanzar, Inspector Thapa and I returned to Ms. Olivo's office at Fiesta Mart #8 where she signed the Receipt for Samples. Copies of the Notice of Inspection, Receipt for Samples, EPA Small Business Resources Information Sheet, and a Confidential Business Information (CBI) notice were provided to Ms. Olivo. The inspection concluded at approximately 1:15 PM.
Section III - AREAS OF CONCERN An area of concern identified during the inspection includes the distribution or sale of a potentially noncompliant FIFRA product as described in the section above.
Section IV - FOLLOW UP No additional information has been requested or received by EPA after exiting the Facility on January 13, 2026.
