I met with the owner, at the opening conference. I presented my credentials to as I informed him that this was an EPA inspection to determine the facility's compliance with the Clean Water Act (CWA), specifically the National Pollutant Discharge Elimination System (NPDES) regulations. The scope of the inspection was a Compliance Evaluation Inspection. Following the opening conference, left us to carry out the remainder of the inspection unaccompanied. FACILITY DESCRIPTION Livestock Auction is a cattle sale barn which holds two sales per week; one sale on Tuesday and one sale on Thursday. For the Tuesday sale, cattle are typically dropped off on Mondays and picked up by Tuesday. For the Wednesday sale, cattle are typically dropped off on Wednesday and picked up by Thursday. The facility auctions cows, bulls, calves, and feeders. In the twelve months between November 2018 and October 2019, the facility held ninety-six (96) sales. Over this same twelve-month period, the facility confined and sold an average of 2,788 animals per sale day. The animals are housed in approximately 9.8 acres of uncovered pens. The open lots are scraped several times per week and the scrapings piled in uncovered area a three-acre area abutting the northeastern edge of the lots. The nearest waterbody in the watershed, , lies 70 feet east of the facility's bermed containment area. Section II - OBSERVATIONS Open Lots & Manure Piles: At the time of the inspection, I observed the lots to be well-kept and generally clean. I observed the uncovered three-acre area where the manure/lot scrapings were being stockpiled (Photos #1-3). This three-acre area was contained within a larger thirteen-acre area that was designed to receive runoff from the production area. This area was bermed on three sides to prevent wastewater from leaving the containment area [AOC 1]. This containment area has no liner and has not been certified by a professional engineer for lack of hydrologic connection; neither have the capacity or integrity of this bermed area been certified by a professional engineer. informed us that, until recently, the facility had an agreement with an individual who would come collect the lot scrapings and haul them offsite; however, as of the date of this inspection, this arrangement was no longer in place. An operator of an unpermitted CAFO is never authorized to discharge from the CAFO under Clean Water Act 301(a). All wastewater runoff must be prevented from entering a water of the U.S. As a best management practice, limit the amount of time manure is stored onsite; additionally, conduct regular visual inspections of the berm to ensure that wastewater cannot exit the storage area.
