Yates, North Dakota 58538 Facility Phone: Facility Representative: EPA Facility ID Number: Reason for Inspection: Inspector(s): 701-854-5511 Clayton Hagel 3040002 Routine Compliance Inspection Andy Woodward, EPA Marta Grabowski, EPA UST System Description Hagel's Service (Facility) is a privately-owned gas station located within the boundary of the Standing Rock Reservation, North Dakota. The fuel at this Facility is sold to the public. The Environmental Protection Agency's records indicate that the Facility has two STIp3 underground storage tanks (UST), which were installed in December 1999. The first tank (Tank 1) is 10,000 gallons and contains 87 unleaded with 10% ethanol. The second tank is compartmentalized into two separate storage compartments. The first compartment, Tank 2a, is 6,000 gallons and contains straight 87 unleaded fuel. The second compartment, Tank 2b, is 4,000 gallons and contains diesel fuel. The Facility piping is a safe suction system with a single-walled, steel construction. Inspection Narrative On September 26, 2023, the EPA UST program personnel conducted an inspection at Hagel's Service in Ft. Yates, North Dakota. The EPA last inspected the Facility on November 4, 2020, and it was selected for routine reinspection. On September 19, 2023, Andy Woodward spoke to the Facility manager to schedule the inspection and asked for a list of UST documents to be available for the inspectors to review (see Attachment A). 3040002 - Hagel's Service Page 1 of 3 9/26/2023 UST Inspection The EPA inspectors arrived at the Facility at approximately 9:20 a.m. Central Daylight Time (CDT). Andy Woodward introduced himself and presented his inspector credentials. He filled out a Notice of Inspection (NOI) (see Attachment B) and requested a signature. Andy explained that the NOI serves as documentation of consent for the EPA to conduct an inspection. He stated that he would provide the NOI to them at the end of the inspection. The EPA inspectors began with a review of the Facility UST records, followed by a physical inspection of the UST system. EPA inspectors took photographs of the UST system components during the inspection (see Attachment C). A Facility representative assisted with the physical inspection. Tank Leak Detection Tank leak detection consists of a Franklin Fueling System EVO-200 automatic tank gauge (ATG). Facility representatives provided nine months of printouts from the system console for all three tanks. Passing tank leak detection tests from January 2023 thru September 2023 were physically observed. At the time of inspection, the most recent annual operability test for the ATG was from March 5, 2021. Piping Leak Detection The piping at this facility is a European style safe suction system using single-walled steel pipes. Cathodic Protection The facility uses a sacrificial anode cathodic protection system for the steel tanks and pipes. Documentation shows the last two system tests were conducted by Hobbs on May 10, 2023, and August 30, 2019 (see Attachment D). Periodic Testing/Inspection of Spill and Overfill Prevention Equipment Current documentation of the triennial spill buckets tests and the overfill prevention equipment (flapper valves) tests were conducted on March 9, 2021. All three spill buckets show passing results. Tank 2a overfill device failed and was replaced on April 26, 2021. Periodic Operation & Maintenance (O&M) Walkthrough Inspections Monthly walkthrough inspection checklists were completed for the last twelve months. No annual walkthrough inspection checklist was available at the time of inspection. Operator Training The Facility provided a record of class A operator training for Clayton Hagel dated January 13, 2021, and a record of class B operator training for Charles Gullickson dated January 14, 2021. There was no list of class C operators available at the time of the inspection. 3040002 - Hagel's Service Page 2 of 3 9/26/2023 UST Inspection Financial Responsibility The Facility is currently registered with the North Dakota Department of Environmental Quality (DEQ). Physical Observations The EPA inspector viewed the spill buckets, overfill devices, earthen sumps, pumps, automatic tank gauge access points, vent lines and ATG console. All appear to be functional and intact. Conclusion At the conclusion of the inspection, Ms. Grabowski notified the Facility that it was out of compliance and filled out an Onsite Deficiency Identification Form (see Attachment E), addressing the areas of noncompliance and the recommended corrective actions required to be taken. These items were identified from the inspection checklist (see Attachment F). Andy Woodward completed the NOI form and the Facility representative signed and received a copy.
