Dear Document Control Office:
In response to an Open Public Records Act (OPRA) request submitted to the New Jersey Department of Environmental Protection (NJDEP), DuPont received documents containing results for PFOA water analysis from multiple public water districts located throughout New Jersey. A copy of the documents containing the test results is enclosed with this letter. The documents are identified with the prefix DEP2-SDWB before the document control number.
DuPont also encloses a copy of documents with the prefix NJAW before the document control number. New Jersey American Water Company produced these documents in response to a subpoena served by Plaintiffs' counsel in litigation against DuPont. DuPont received copies of the documents from Plaintiffs' counsel.1 These documents contain water sample results.
All documents are provided as received from NJDEP and Plaintiffs' counsel. DuPont does not attest to, and has not verified, the accuracy of the information and results in the enclosed thirdparty documents. It is, however, noted that a 0.50 ppb (ug/L) drinking water action level was developed by EPA and is set forth in a Safe Drinking Water Act Order on Consent amongst EPA Region III, EPA Region V, and DuPont.2
Attached to this letter is a listing of the enclosed documents. The documents are provided in paper copy and on CD for inclusion in the above-identified docket and any other applicable docket.3

These results are submitted to EPA in view of the Agency's continuing interest in perfluorinated substances and because it is unknown whether NJDEP, the water districts, or any other entity has already provided the results to EPA.
