Good afternoon, counselors, I'm a writer for Westlaw's online news service and I'm working on a short article about Friday's decision by the D.C. Circuit, rejecting NEDACAP, API and APF's challenge to EPA's 2017 Regional Consistency Regulations.
What do you consider the most significant aspect of the panel's decision, and why? Also, what did you think of Senior Judge Silberman's suggestion, in the concurrence, that EPA could avoid inter-circuit conflicts by certifying more challenges as being "of nationwide scope or effect"? Is that a reasonable alternative for the EPA?
