Dear Richard: Enclosed herewith is a copy of the Minute Order of the District Court stacking this case on the calendar of Monday, August 3, 1992. Initially, let me say I think this is a Good Thing, but it does create some problems for both sides. First, it has to be a frightening wake up call to the defendants. I am still convinced that they do not want to try this case and are merely stalling - both for time and as a strategy. Probably they will seek a continuance. We will oppose it, but my guess that they will be granted a continuance for a limited period of time. If there is no continuance, this case could go to trial as early as the last week in August, but more likely in September or October. In the meantime, we are preparing to file a Motion for Partial Summary Judgment on the issue of liability under the fraud and failure to warn claims. We also are preparing notices of depositions, interrogatories and other discovery.
