Section 240.103 Prohibitions
Except as permitted or authorized by law. no person shall fail to maintain in pood working order or remove, dismantle, or otherwise cause to be inoperative any equipment or feature constituting an operational element of the air pollution control systems or mechanisms of a motor vehicle.as required by rules or regulations of the hoard and the United States Environmental Protection Agency to be maintained in or on the vehicle..
Section 240.104 Inspection
All motor vehicles subject to inspection pursuant'to'Sectlon 13A-104 of, the Illinois Vehicle Emissions Inspection Law (111. Rev. Stat. 198S, Ch.. 9S 1/2. par. 13Arl04) shall comply-with the exhaust emission standards for carbon monoxide and hydrocarbons set forth at Section 240.124 of this Part.

Section 240.10S Penalties
a) Any violations of Sections 240.103. 240.121. 24o:i22. and 240.123 shall be subject to the penalties as set forth in Section 42 of the
- Act (111. Rev. Stat. I98S. ch. Ill 1/2. par. 1042).
b) Any violations of Sections 240.104 and 240.124-shall be subject to the penalties as set forth in Sections 13A-112 and 13A-1I3 of
. the Vehicle Emissions Inspection Law (111. . .Rev'. Stat. I98S. ch. 95 1/2. par. 13A-112. ,,-13A-!ttj.

Section 240.106 determination of Violation
a) Any violations of Sections. 240.103. 240.121. 240.122. and 240.123 of this Part shall be determined by visual observation;.or by a test-procedure employing an opacity measurement system as qualified by 35 111.
` Adra. Code 201. Subpart 3.
b) Any violations, of Section 240.124. shall be determined in accordance with test procedures adopted by the Agency.

SUBPART B: EMISSIONS -
Section 240.121 Smoke Emissions
a) There shall be no visible emissions of smoke from a motor vehicle, zero opacity.
b) Motor vehicles traveling Illinois publ'c highways from out of State must comply with
, subsection (a).
e) No used motor vehicle shall be sold or transferred, in Illinois unless that said vehicle meets subsection (a).
Section 240.122 Diesel Engine Emission Standards
1 a) Ihe visible emission standard in Section 240.121 shalT ndC'apply to diesel engines.
b) With the exception of subsection (e). diesel engines manufactured before January 1. 1970. shall not be operated; in such-a-manner as-to. emit smoke which is. equal to or greater than
- 30X opacity except for individual smoke puffs. Individual puffs of smoke shall not exceed IS second? hr durations.............

1) Diesel engines shall be operated only on the specific fuels as specified in the engine manufacturers* specifications Tor . that specific engine, or on fuels exceeding engine manufacturers* specifications.
2) Persons liable for operating diesel engined; Meets whol 1y within 'standard" metropolitan statistical areas shall furnish to the Environmental Protection Agency, once each year, proof, that the fuel purchased and used in their operations conforms to subsection (c)(1).
d) All diesel engines' operated on public . highways in Illinois coming from out of the , State shal l conform to subsect Ido (b).
