Lewis Avenue, #300 Tulsa, Oklahoma 74136 Re: Notice of Warning Letter EPA Docket No. FIFRA-06-2026-0363 Dear Ms. Branch: Region 6 of the United States Environmental Protection Agency (EPA) is issuing this Notice of Warning to Fairway Brothers Distribution, LLC ("Fairway Brothers Distribution") pursuant to Section 9(c)(3) of the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA), 7 U.S.C. 136g(c)(3). This action concerns the pesticide "Clean Fight Disinfectant" (EPA Reg. No. 96865-1-99348). On October 30, 2024, EPA conducted a for-cause FIFRA inspection at Fairway Brothers Distribution based on suspected distribution or sale of unregistered or misbranded pesticides derived from "D.O.D. [Disinfectant on Demand]" (EPA Reg. No. 96865-1), including the sub-registered Clean Fight Disinfectant product. As a result of the inspection, as well as a review of a website operated by or on behalf of Fairway Brothers Distribution (URL: https://cleanfight.com), it was concluded that Fairway Brothers Distribution distributed or sold a misbranded pesticide in violation of Section 12(a)(1)(E) of FIFRA, 7 U.S.C. 136j(a)(1)(E), and produced that pesticide in an establishment not registered with the EPA in violation of Section 12(a)(2)(L) of FIFRA, 7 U.S.C. 136j(a)(2)(L). Based on EPA's investigation, including the review of Fairway Brothers Distribution's compliance history, the EPA has concluded that a Notice of Warning is the appropriate enforcement response.
