Returned th is aom in g 'fros trip to Birmingham to investigate
the available fa cts In the case of
Warrior
Alabama, and to t e s t i f y , I f advisable, m-rn!tl^Wmage su it
against Standard- On o f Kentucky, Under circumstances was
unable to see claimant or h is physicians or his attorneys.
Prom a v a ila b le 'fa c te , however, am quite-Pertain that
v^
claimant has, not suffered from lead poisoning as a oonse~
quenee o f drinbing water containing leaded gasoline. Hearing
o f case, however, was postponed u n til f a l l session of Federal
Court. I t appears that in damage suits-of"" th is type where
the amount involved exceeds #3^U000V t h e,`case may be trans
ferred to the Federal Court. This was done in th is oase
and i t w ill appear at a .la te r date,
There has been no opportunity to examine th is p atient or to obtain f i r s t hand information concerning.his Injury, My conclusions as to the in sign ifican ce of lead absorption < in his caso is based on the fa c t that there has at no time appeared any claim o f g a stro -in te stin a l symptoms such as thoso inevitably associated with the ingestion of gasoline. In an e a r lie r period, patient complained of. abdominal pain xfhieh at that time was associated with vomiting blood and the presence of blood in the s to o ls . This occurred on one occasion in aosociatlan,w ith-prevlprnw history suggestive1 o f g a stric u lcer over a period of approximately four years. I t seems apparent from the p a r tia l report o f h is physician that th is had no re la tio n to any ingestion of gasoline since at no time was there any diarrhoea, toxic e n te r itis or cen tral nervous system symptoms. Any, further pertinent f a c t s w ill have to be obtained a t the time o f the hearing of the damage s u it, -
