Sen. Tammy Duckworth (D-Ill.) asked the FBI to launch a criminal investigation today into whether Carl Icahn violated conflict of interest laws with his efforts to alter the Renewable Fuel Standard.
"Mr. Icahn appears to have abused his role as a special advisor to the President of the United States on issues relating to regulatory reform by participating personally and substantially, through recommendation and the rendering of advice, on a government matter that directly affects his own financial interests," Duckworth wrote in a letter to the agency.
Senate Democrats have written letters seeking information about Icahn's actions on the RFS, but Duckworth's letter is the first to call for a criminal investigation. Democrats have previously called on the White House and the EPA to provide information about Icahn's role, and they have asked the Securities and Exchange Commission, Commodities Futures Trading Commission and EPA to conduct investigations.
Icahn held the title of special adviser to the president until he gave it up earlier this month. Duckworth cites media reports that Icahn used his position to pressure outside groups to support changes to the RFS that would benefit his refining company CVR Energy. That move, she says, would put him in violation of federal ethics laws.
