Dear Steve:
In re: 81 OD 609
v. Sherwin-Williams
This case appeared on the docket in Litchfield March 7, 1985. No one was there on behalf of the Petitioner.
Since then, I have received the attached "Notice Of Case Dismissal" indica ting that the cause has been dismissed by Arbitrator Boyd for want of prose cution. There is sixty (60) days frcm the date of receipt of the dismissal within which a Petition to Reinstate may be filed. While I anticipate that this will happen, let's wait it out.
What I had been planning to do, Steve, was to get over to the SIU School of Medicine Library and take a look at the Berman book on Toxic Metals and their Analyses. I mentioned this to you in my letter of November 8. As I recall. Dr. Berman may be based sctnewhere in Chicago, and as I indicated in my November 8' letter, we could see if we could get a written statement or affidavit frcm her assuming it would be favorable. The identification of the book, and of Dr. Berman, I shall follow up on very soon, then we can decide on the timing of contacting her once her location is established.
With best regards, I am
Very truly yours,
