D u rin g two days he worked in s id e a, huge steam b o i l e r s c ra p in g r u s t from th e u n p a in te d i n t e r i o r o f t h i s new ir o n b o il e r ; th a t f o r a couple o f days he a p p lie d p a in t to th e i n t e r i o r o f t h i s b o i l e r . T h is p a i n t h ad a g r a p h ite base w ith a th in n e r known as Sunoco S p ir its , th e l a t t e r beiqg a re fin e d f r a c tio n from petroleum and belongs to th e c la s s o f p etro leu m p ro d u c ts known a s petro leu m s p i r i t s . I t conforms to th e s p e c ific a tio n s o f the American S o ciety fo r te s tin g m a te ria ls fo r petroleum s p ir it s desig n ated D 235-39 and also to th e ir s p e c ific a tio n s f o r S to d d a rd S o lv e n t, d e s ig n a te d a s D 4 8 4 -4 . These Sunoco s p i r i t s do n o t contain added in g red ien ts o f any s o rt, nor is a n y th in introduced in the re fin in g process. I t is a s tra ig h t petroleum fra c tio n . I t is in its e lf supposed to be non-toxic and obviously does not contain any to x ic m etals such a s le a d , bism uth, m ercury, e t c . and fu rth erm o re i t c o n ta in s no b en zin e. C laim ant worked u n t i l th e jo b was com pleted, ap p ro x im ately th r e e weeks. A fte r te rm in atin g h i s employment, p l a i n t i f f had p a in s in h is stomach p a l l o r an d a f e e l i n g o f g e n e r a l w eakness; some d iz z in e s s , lo s s o f a p p e t i t e and two o r th re e days a f t e r q u itin g work was s e n t to th e h o s p ita l where th e a tten d in g p hysician diagnosed case as le a d poisoning, due to the use of the p a in t claim a n t was u s in g on th e b o il e r . I t was b ro u g h t to th e a tte n tio n o f the doctor th a t th is p a in t d id not contain any lead but the doctor s ta te d th a t n e v e rth e le s s th e claim an t c l i n i c a l l y had le a d p o iso n in g and he gave him the Aub tre a tm e n t which a p p a re n tly d id n o t have any pronounced b e n e f i c ia l e f f e c t s . D uring th e s ta y in th e h o s p ita l th e re d c e l l count was around f iv e m illio n and the w hite c e ll oount v a rie d from 10,000 to 14,200. A smear from the gums f o r V in c e n ts d is c l o s e d numerous s p e ro c h a e te s an d f u s ifo rm b a c i l l i . The a tte n d in g p h y sic ia n s ta te d he found s t i p l e blood c e l ls and le a d in the u r i n e , and t h a t on May 18, 1942 a ch em ist exam ined th e b lo o d f o r le a d and found 385 micrograms o f le a d p er 100 m i l i l i t e r s blood and th a t a chem ical exam ination o f the u rin e , 350 micrograms o f le ad p er l i t e r . . During th e p erio d January to June, 1942 claim ant' s p h y sical exam ination showed w hat an e a r d o c to r d e s c r ib e d a s some n erv e d e a fn e s s . The a tte n d in g p h y s ic ia n was u n ab le to make any d i f f e r e n t i a l d ia g n o s is . I re a liz e th a t th is is a very sketchy h isto ry of th is case.
