Section I - INTRODUCTION
CapturePoint, LLC / North Burbank Unit, Well # 10-13 Inspection Date 05/25/2023
PURPOSE OF THE INSPECTION
EPA Region 6 inspectors Matthew Allen (lead inspector), Jeanne Eckhart, Tamara Griffin and Michael Blaha arrived at the CapturePoint, LLC / North Burbank Unit (NBU) (EPA ID No. OKU000808) at 12:10 PM on 05/25/2023 for an announced inspection. This was an EPA inspection in response to a National Response Center Spill Report (NRC No. 1367639) which was received by EPA Region 6. The inspection was conducted by the authority of the Clean Water Act (CWA) to determine compliance with Environmental Protection Agency (EPA) regulations. CapturePoint, LLC representative, Talia Clark, participated throughout the inspection. There was no other federal, state, or local agency representatives present at the time of the inspection.
FACILITY DESCRIPTION
EPA conducted an inspection at the CapturePoint, LLC, North Burbank Unit (NBU), well # 10-13, where an inactive well released CO2, produced water/oil and drilling mud to the land surface, ultimately impacting an unnamed tributary as released fluids migrated downgradient. The released fluids traveled in a general northward direction.
Section II - OBSERVATIONS
I observed the ongoing release, which was well NBU 10-13. Well # 10-13 (release point) can be seen in the Appendix 1 (photo log) photo's 1 and 2 which is attached to this report. From this same location, I observed the first and uppermost, temporary containment pit/dam which can also be seen in the photos. GPS location information is stamped on each photo as well as listed in the metadata section below each photo in the photo log.
I observed the second, temporary containment pit/dam which can be seen in photo No. 3. While the release was being contained at the time of the inspection, we maintained a safe distance from the active release in areas closest to the release point.
I observed the third, temporary containment pit/dam and observed a TDS field reading of 79,899 milligrams per liter (mg/L) from the contained waters. This was the highest level of TDS observed during the inspection. These observations can be seen in photos 4 and 5. All TDS field readings were taken the EPA issued, properly calibrated, YSI Pro 30 conductivity meter. At the same location, I observed water transfer pumps removing water from the catch pit and transferring it to a nearby underground injection facility as stated by Talia Clark.
I observed the initial pure/release discovery point. Talia Clark stated the release was initially discovered at this location and initial containment measures were implemented, but the ultimate source of the

purge was traced back to well # 10-13. The initial discovery area can be seen in photo No. 6. At the same location I observed an elevated TDS field reading of 42,701 mg/L, which is documented in photo No. 7. I observed the fourth downstream containment pit/dam as well as an elevated TDS field reading of 16,731 mg/L. These observations can be seen in photo's No. 8 and 9.
Immediately downstream from the 4th and lowermost temporary containment dam, I observed an elevated TDS field reading of 4,911 mg/L (see photo No. 10) This observation suggested the contaminated water may be leaching through or under the lowermost containment pit/dam. Talia Clark stated she would have men and equipment place an additional downstream containment dam to prevent further downstream migration of elevated TDS waters.
Continuing downstream, I observed an elevated TDS field reading of 3,113 mg/L which can be seen in photo No. 11.
Continuing north/downstream, I observed an elevated TDS field reading of 1,769 mg/L which can be seen in photo No. 12. Talia Clark stated from about this point and continuing downstream, we could also observe historic spill impacts, which were under ongoing cleanup operations. I did observe a small gasoline water pump and transfer hose near this location as evidence of recent cleanup activities.
I observed an elevated TDS field reading of 1,459 mg/L along the impacted tributary. This represented the lowed observed TDS field reading along the main channel of the tributary. At the same location, I observed the bed and bank features of the impacted tributary, these observations can be seen in photos No. 14 and 14. There were no containment structures below this point to prevent downstream migration of impacted waters.
I observed a TDS field reading of 931 mg/L taken in an unimpacted stream just upstream, before the confluence with the impacted tributary. I observed the bed and bank features along the unimpacted stream. This TDS field reading was equivalent to background TDS levels in the area. These observations can be seen in photos No. 16 and 17.
Section III - AREAS OF CONCERN
The primary areas of concern included the ongoing purge/discharge of saltwater, the impacted overland flowpath and the impacted, unnamed tributary which ultimately connects to Kaw Lake.
During the inspection, Talia Clark, representing CapturePoint, LLC stated the company would place an additional downstream containment dam to prevent additional downstream migration.

On 05/26/2023, inspector received photos of 3 additional containment dams which had been placed by the operator along the impacted tributary.
EPA inspector will continue to follow up with site visits and phone calls until the impacted areas are restored.
