M-l Birth Defect-Causing Toxic Waste............................................................................................................N-l Toxic Waste by Zip Code.......................................................................................................................... 0-1 DSW 133878 STLCOPCB4033836 Poisons in Our Neighborhood Introduction Poisons in Our Neighborhoods details manufacturers' toxic chemical pollution for 1992, the most recent year for which information is available.1 The report uses data that individual manufacturing facilities were required to file with the U.S. Environmental Protection Agency (EPA) under the Emergency Planning and Community Right-to-Know Act, Title El of the Superfund Amendments and Reauthorization Act of 1986, and the Pollution Prevention Act of 1990. Toxics Release Inventory Reporting Requirements Manufacturing facilities with ten or more employees using or manufacturing certain quantities of some 300 toxic chemicals and 20 chemical categories must file Toxics Release Inventory (TRI) forms with EPA and the appropriate state agency each July 1. Facilities which manufacture 25,000 pounds or use 10,000 pounds of one of the listed chemicals must report. A separate report is filed for each chemical. In addition to basic identification information, facilities that fall under the reporting requirements must submit the following data: the maximum amount of the chemical on-site; the amount of the toxic chemical released directly into the air, water and land (called "releases"); the amount of the toxic chemical transferred to public sewage treatment plants and off-site waste disposal facilities (called "transfers"); the amount of the toxic chemical recycled, burned to generate energy and treated; waste treatment and disposal methods employed; Toxic release reports for 1993 were due in July, 1994. They are not yet electronically available. 1 DSW 133879 STLCOPCB4033837 Poisons in Our Neighborhood the production level of the facility relative to the previous year, and; activities facilities took to reduce the chemical at the source. The toxic chemicals released into the environment, transferred off-site, recycled, treated and burned to generate energy make up the total production-related waste for the facility. Facilities with less than ten employees are not required to report, nor are facilities which do not meet the appropriate chemical thresholds. Although non-manufacturing facilities are not required to report under current law, EPA is planning to require some categories of non-manufacturers to report in the future. EPA has also proposed to double the number of chemicals that facilities must report. Beginning next year, federal facilities must comply with TRI reporting requirements. Causes of Year-To-Year Changes in the TRI Releases and transfers of toxic chemicals have declined steadily since the first year facilities reported them; facilities have not reported total production waste for a long enough time to have established a trend. Because the TRI does not collect sufficient data to establish why facilities have reduced their estimates of releases and transfers, interpreting year-to-year changes is difficult. EPA's own analysis of TRI changes confirms that a majority of the reported reductions have not reflected real, permanent decreases in toxic chemical releases. In a survey to determine the causes of TRI reductions which occurred between 1989 and 1990, EPA reached the following conclusions:2 Modifications to reporting guidance, reporting errors, increased recycling, extraordinary events such as spills, and reasons which the facility were unable to explain accounted for 48% of the changes at surveyed facilities. Pollution prevention initiatives were responsible for about 45% of the changes. Fluctuations in production levels accounted for about 5% of the changes. Changes in the techniques used to estimate releases were responsible for 3 % of the changes. 2 U.S. EPA, Assessment of Changes in Reported TRI Releases and Transfers Between 1989-1990. May, 1993. 2 DSW 133880 STLCOPCB4033838 Poisons in Our Neighborhood The only certain way to determine whether a facility is making progress in preventing pollution or reporting only paper changes is to ask a facility representative for documentation. Previous facility surveys by Citizens Fund have also found that year-to-year changes often involve only changes in reporting methodology, variations in production levels and one-time events such as spills rather than actions that result in permanent reductions.3 Sources ofthe Data Poisons in Our Neighborhoods is based on EPA's 1992 TRI. It may contain data entry errors committed by EPA, and it may not include revisions facilities have made since they submitted their initial reports. Only later versions of the data, which are not yet available, will contain most revisions. These data are the most recent version of the TRI available electronically. The health effects information used in this report is based on a toxicity matrix prepared for EPA/ Carcinogens - Chemicals indicated as causing cancer meet one or more of the following criteria: (1) classification as human or animal positive or suspected carcinogen by the International Agency for Research on Cancer; (2) classification by EPA as known, probable or suspected carcinogen, or; (3) indication of tumor induction, based on the GENETOX on-line database. Birth-defect Causing - Chemicals are classified as causing birth defects based on reports of positive results from studies on heritable mutation in germ cells as reported to the GENETOX on-line database.
