Hurd subject Construction Standards and Interpretations location Portland location Portland date January 25, 1977 There still seems to be questions and some confusion over the Occupational Safety and Health Standards for the Construction Industry as they apply to airborne asbestos dust requirements. I refer now to Subpart D - Occupational Health and Environmental Controls of the Construction Standards. Standard 1926.55 - Gases, Vapors, Fumes, Dusts and Mists states that, "whenever any employee is exposed to airborne asbestos dust, the requirements of 1910.93a of this title shall apply." Part 1910 Standards are General Industry Standards and Interpretations which apply to all other industry, consequently for purposes of airborne asbestos dust, the requirements are the same for the Construction Industry as they are for us. I believe the confusion stems from reports of OSHA inspectors stating that it is illegal for Construction Contractors to use joint systems products which contain asbestos. This statement is not correct as it is perfectly legal for any contractor to use products which contain asbestos, however, they must comply with the regulations referred to above. JRH:ns J. R. H.
