We received the attached Notification of Decision on Review on Friday, November 7, 1986. The commission has reversed the decision of the arbitrator, stating only that decedent was exposed to an occupational hazard which aggravated his pre existing condition, and therefore causally connected to the death.
Note that only Chairman Bachman and Commissioner Black signed the Notification of Decision. Whether that means that the new ccirmissioner, Holland, did not concur^, we can only guess.
I immediately drew up a written request for a decision in writing, and mailed it on to the commission, with copies to claimant's counsel and the Treasurer, State of Illinois. A copy of that is attached.
We should now turn our attention to an appeal to the Circuit Court, Montgomery County. The time in which to bring that appeal will not start to run until the decision in writing is received. We can think ahead however to arranging the bond. The amount of bond will be fixed by the commission's decision on review, however we should make some arrangements with a surety ahead of time so that we won't run down to the wire, timewise, in perfecting the appeal.
