Environmental Protection Agency Region 4 Air Enforcement Branch 61 Forsyth Street, SW Atlanta, Georgia 30303 INSPECTION REPORT Facility Inspected The Smokin' Texan 2864 East Cherokee Drive Suite A Canton, Georgia 30115 Inspection Date: March 29, 2023 Facility Programmatic ID 3601516761 LAT: 34.1741 LON: -84.4185 Inspection Type Clean Air Act (CAA) National Emission Standards for Hazardous Air Pollutants (NESHAP) - Asbestos Inspector Pamela Storm Introduction An inspection pursuant to Section 114 of the CAA was conducted on March 29, 2023, at The Smokin' Texan located at 2864 East Cherokee Drive, Suite A, in Canton, Georgia 30115 (the facility). The unannounced inspection was conducted by Pamela Storm who possesses EPA inspector credentials to conduct CAA NESHAP asbestos inspections. The facility was closed until further notice when I arrived at the facility. The purpose of this inspection was to determine compliance with the CAA NESHAP Asbestos Standard and the regulations promulgated at 40 CFR Part 61, Subpart M, for the renovation activities that a tipster alleged had been conducted at the facility. The EPA Region 4 CAA NESHAP asbestos program targets facilities for inspection located in the State of Georgia based on tips/complaints; permits issued on a local level; and demolition and/or renovation/abatement notices sent to the State. This inspection was conducted based on a tip/complaint. Facility Information The facility is a restaurant. Inspection Inspection I spoke with Keith Kendrick, the owner, who was at the site. I presented my EPA inspector credentials and explained the purpose of the inspection. He said that an application had been submitted to the Cherokee County Building Department by his fire suppression company which submitted drawings of the existing tanks and hood system. The facility was previously a Shane's Barbeque restaurant. He added that cosmetic modifications (painting and decorating) were the only modifications done to the restaurant. He explained that the facility was closed until further notice due to partnership disagreements. The Smokin' Texan opened on March 1, 2023, for three days. Conclusion No renovation or demolition activity appeared to be occurring or appeared to have occurred at this facility at the time of this inspection. This case will be closed since there is no evidence of any activity regulated by the Asbestos NESHAP having occurred at the facility.
