Feldman Director, Regulatory and Scientific Affairs American Petroleum Institute 1220 L St, NW Washington, DC 20005-4070 Dear Howard: This letter is intended to request expedited funding for Cinpathogen, Inc. to meet immediate funding needs and to meet previous financial obligations in connection with the Shanghai Health Study (SHS). Background on Cinpathogen, Inc. Cinpathogen, Inc. is a US corporation registered in Delaware and based in Colorado that was established at the request of Fudan University to manage and administer operations of the SHS at the Institutes of Biomedical Sciences (IBS), part of Fudan University. Establishment of this private entity was requested by IBS as the preferred mechanism to complete the study and interact, as necessary, with the SHS study consortium. This entity will provide the greatest probability for continuity of the lab after completion of the SHS, an original priority of the consortium. We believe that this private entity provides a greater chance to retain staff and therefore complete the study according to the planned tirneline. Current Status The current funding shortage developed as a consequence of 1) the end of funds budgeted for Fudan University through the University of Colorado contract, 2) the necessity to reorganize laboratory and research operations at Fudan University to provide effective transition in management for the conclusion of the SHS, and 3) delays in the schedule for BHRC approval of the funding extension for the project. In effect, there have been no funds available to the laboratory since December 31, 2006. In the present situation, ongoing clinical laboratory and exposure assessment (EA) operations are hamstrung by the inability to pay staff salaries, honor debts previously incurred from vendors, participating hospitals and subjects, or to effectively administer ongoing efforts to recruit personnel or meet regulatory and administrative requirements. SH ELL-MCCLU RG-062063 I have been informed as of this morning, that as of Monday, April 2, 2007, the laboratory may have to temporarily stop taking cases until this problem is resolved. Since then I have been in telephone and e-mail contact with the IBS administration and the vice president of Fudan University and requested that they intervene in the short term. Clearly, they would be in a much better situation to intervene if funding from Cinpathogen was provided to IBS Therefore I am requesting expedited funding in the amount of $2,000,000 to pay for salaries, support laboratory and EA operations and honor debts including administrative, vendor, hospital, laboratory and subject costs through June, 2007. This initial funding is not intended to defray all costs borne by the project for the January-June time frame, but will enable operations to continue while the process of funding the final approved extension budget goes forward. This sum is subsumed within the Cinpathogen, Inc budget (to be forwarded under separate cover) for the approved extension of the SHS for 2007-2008. Sincerely, Richard D.
