Dear Mr. Locker:
In response to yours of October 20, 1983, there have been no significant developments in the above-captioned matter since our June 14, 1983 correspondence.
We still are awaiting the full medical reports of all phy sicians who had treated the plaintiff for a number of years prior to the onset of her cancer, and have recently discussed this with plaintiff's attorney, requesting that the records be forwarded to us.
If we are not in receipt of these records in the next couple of weeks, it is our intention to make a motion to compel the pro duction of these records or to compel authorization for us to contact the medical providers directly and obtain the records ourselves.
As previously noted, this case was placed on the general court docket in January of 1983, and will have to be restored to the active trial calendar on or before January, 1984, or else be deemed to be automatically dismissed for failure to prosecute pursuant to applicable New York law.
