Section 6 compeh employer* to provide i monthly physical ex amination for each employee who b exposed to lead dust, bad fumes or lead solutions to ascertain the symptoms of lead prisoning. The esamlnatton, which is given during srorfcing hours, must be made by a licensed physician, designated and paid by the employer.
Although It b the duly of the employer to employ a licensed phy sician, the employee b required to submit himself to such examina tion and to any other examination which the employer reasonably may request and to answer trnthfuBy all questions bearing on lead poismlng asked him by the examining physician.
Section 7 requires the physician making the examination, if he discovers what be believes to be symptoms of lead poisoning, to make a complete record of the examination, imficatlng the name and address of the employee examined, the particular work or process In which the employee b engaged, the dale, piece and find ings of the examination, and the directions given in each case by the physician. The record of the physician b open to Inspection by the Department of Labor and Industry and the Department, of Health.
Section 7 abo requires the examining physician to report any findings of symptoms of lead prisoning to the Department of I-abor atul Industry end to the Deportment ul Health within 48 hours of the examination. Within the same time limit, the examin ing physician must report the findings of his examination to the employer. After this notification, an employer may not employ the particular employee In any work or process where he will con tinue to be exposed to lend dust, lend fumes or lead solutions.
' Any employer who falls to comply with sections 5,6 or 7, and any employee who fails to submit to the physical examinations required by section 6, is guilty of t misdemeanor and nay be sentenced to pay a Roe of not less than $10 nor more than $10. There b no provision for Imprisonment In lieu of payment of the fine and costs. There Is also no provision for the Imposition of graduated fines for subsequent violations of these sections.
Section S authorises the Department of Labor and Industry to enforce the provisions oi the act, and sets forth the penally provi sions fur violatlua. Any authorised representative of the Depart ment of Labor end Industry has the right at any reasonable time to inspect any establishment which manufactures lead.
