DuPont Internal Report, "Study Of Myocardial Infarction At Washington Works Plant" (1975) (DUPONT910-918);i/ and 2. E.I. duPont de Nemours and Company's Objections And Response To Plaintiffs' Third Set Of Interrogatories And [Sixth] Set Of Requests For Production Of Documents (April 28, 2003).- RAB/mdm Enclosures cc: R. (by telecopy and Federal Express) - As a Defendant in a class action lawsuit pending against DuPont in the West Virginia State Court in which we serve as Class counsel, DuPont has the right to mark documents produced in that case as falling under the terms of the Stipulated Protective Order that allows parties to limit distribution of documents, if they qualify as documents for which "confidential business information" (CBI), protection would be available under, among other provisions, 40 C.F.R. Part 2, Subpart B. Although DuPont originally marked this document as confidential under that Order, DuPont has since confirmed in writing that it has withdrawn its confidentiality claim with respect to this report. - Exhibit B to this set of DuPont's discovery responses has been removed, because the document has been marked "confidential" under the terms of the Stipulated Protective Order referenced above in Footnote 1. We are currently challenging DuPont's confidentiality claim with respect to that document but the issue has not yet been resolved. 000002
