Ro WOLFF At the request of the Chairman, Dr, Lanza reported that Mr, Trichter of the New York City Health Department had received President Battley1s request for post ponement of `the Board of Health1 s , hearing to a date in. October, Dr0 Lanza advised that the subject would come up at the Board meeting on October 8 and Mr,, Trichter would like our suggestions by October 2 for submittal to the Board. Mr. Eckart reported on the meeting of Mr Trichter with rlr, Slocum and himself, He stated Fir# Trichter expressed the opinion that; the Board would require label ing of paint products containing, over 1% lead. It is Hr, Trichter1 s belief that , the labeling of products containing .less than 1% lead should be optional with the industry Mr Slocum reported that Mr#- Trichter exhibited samples of US. made toys (automobiles and sand pail shovels), coated with finishes which con tained by test as much as 2k% lead He also exhibited a whistle made in Japan that contained a high pe rcentage of lead paint on the mouth piece# Fir. Eckart stated that the American Standards Association's Subcommittee has accepted the Z66 Standards# Mr. Mclrmes said Dr,, MaLlins reported to the Chicago group that the Cliicago Health Department wants the ASA designation on labels'. Mro Eckart repoitoed that Mr. Trichter told him the Hew1 York Board of Health will require the sentence "Do Not Use on Surfaces Likely to Be Chewed By ChiMren11# Mr. Eckart suggested that the labeling then be divided into two groups = Flam mability and Lead. : Dr. Foulger believes that labeling must include all hazards. Mr. Eckart suggested "that provisions be made in the labels .for heavy metals other than lead. He. stated the industry should utilize ASA findings in the development and prepara tion of precautionary labels. Hr. Slocum stated it was his understanding that the industry would not favor the use of wording on the labels such as, "Conforms to ASA Standards". However, in dividual manufacturers may adopt such wording if they like. He also stated that we should include heavy metals in our labels and that ASA findings should be followed in this connection. Mr. Slocum moved and Mr. Croll seconded that the wording of the Group I labels read after (Pb) "and shall not contain compounds of antimony, arsenic, cadmium, mercurj^ygeiehix'mi, or:- barium, (when soltSasLe-' "by stirring for, ten minutes with. hydrochloric acid at room temperature) introduced as such in the formulation of such products". The motion was unanimously adopted. Mr. Slocum's motion that the language of Group II be revised to include reference to heavy metals compounds was unanimously adopted. Mr. Ecleart stated that Hew; 'fork City will require that lead be mentioned if the paint contains more than 1^ lead. He reported that Mr. Trichter is of the opinion that mentioning lead on the label is not enough; that the ha.zards must be indicated. Dr. Foulger suggested that the label spell out the hazards other than lead. The question was asked and answered In the affirmative if the Mew York City Department of Health would approve the use of the statement "Contains more thah 1%-lead (Pb)" 'when lead is the only harmful compo-und in thb product. Mr. Echart said that we would have to include the "Do not ap ply on; toys, fur niture or interior surfaces which may be chewed by chaldren" in order to satisfy the Mew York City Health authorities. Mr. Slocum agreed and suggested: that July 1955 be set as the date for compliance with New York City regulations when we get together , with the Mew York Board Of Health authorities. The question was raised regarding the sentence "Keep away from feed and food products" in Group II labels, because California labeling laws require it. The Subcommittee suggested that Dr. Foulger check with the California authorities on the need for the phrase. Mr. Pitt moved that the labels, as revised, be adopted. Much discussion centered upon the wording of each group of the proposed labels. Finally, the motion was unanimously adopted. The labels, as approved, are attached# Mr., John C. Moore reported The Toxic Materials Committee is making progress in preparing a list of harmful ingredients used in paint. Mr. Moore gave a brief, synopsis of how the Association checks on alleged lead poisoning cases. He told of an alleged lead paint poison case in St. Louis and the Washington, D. C. newspaper report of a two year old boy drinking latex paint. The Associa- . tion found, that both cases ore examples, of misunderstanding- and hasty diagnos ing or reporting the cases.: It was emphasized that a Health-Education Program is needed to emphasize to local medical authorities the need of care in diagnosing all ;cases of, suspected paint poisoning. Mr Sckart commended the Committee for the splendid work done, and emphasized that its 30b was not completed; The Subcommittee would continue to function and be available to consider any problems relating to labeling and health educ at!on o The meeting adjourned;, Charles B. (c) Products classified in Group I which contain "odorless" solvents must be labeled with the appropriate Group I labels, but the warning woras "Use with adequate ventilation" must be in type two points larger than the type used for the rest of the appropriate caution label and the label placed in a prominent position on the container. (d) The percent of lead is determined as lead metal (Pb) bas^d on the total solids of the paint. GROUP II - Products containing more than 1 percent of lead as metai (Pb) in a. compound (see Note (b) below), or containing a compound of antimony; arsenic, cad mium, mercury, selenium or barium (when soluble by stirring for 10 minutes with S percent hydrochloric acid at room temperature) introduced as suchi in the formula tion of these products, and containing solvents of the following flash points: Flash Point above 80F. Furthermore, when this wording is Used, the words "Harmful , if . eaten" must appear in the text of the label. GROUP III ,- Products other / than those included in Group H containing significant,, amounts of materials or solvents which may be harmful. . . EPI 000891 -hr When harmful substances, other than those included in Group II are used in paint, . due to formulation variables, it is impossible to establish a general warning label* The paint manufacturer is cautioned to alert himself to such hazards and use an appropriate precautionary label. Extra vigilance should be the rule in labeling harmful Group III products* Label ing of Group III products containing hazardous chemicals to be guided by MCA. GROUP IV - Paint and Varnish Removers (a) Mon-Flammable Removers, such as specified in Federal Specification fT-R-25>lc Remover; Paint and Varnish (organic Solvent Type), Type II.
