EPA has not yet responded to a request Becerra made in April under the Freedom of Information Act for the documents, according to the suit. The case was filed in U.S. District Court for D.C. Becerra specifically requested details about Pruitt's "compliance with federal ethics regulations and obligations." Pruitt has recused himself from working on a number of lawsuits related to rules he sued over, including the Clean Power Plan and Waters of the U.S., although Pruitt said he is not barred from working on regulatory rollbacks or replacements of those rules. Becerra also asked for the agency's "policies and procedures for determining who (if anyone) can assume the powers of the Administrator if he is recused or disqualified from participating in a matter."
