Box 2197 Houston, TX 77252 Gentlemen: Pursuant to 15.1, 15.5 and 12.5 of the Asset Purchase Agreement letters dated July 20, 1984, between E. I. Dupont De Nemours & Company, Conoco, Inc., and Vista Chemical Company (Vista), we hereby provide notice of recently-discovered information that may lead to the filing of an Environmental Claim. On May 14, 1991, 0SHA conducted an inspection of the Rhone-Poulenc Plant in Hammond, Indiana. This plant is immediately adjacent to Vista's plant. We have been told that during the inspection, a Rhone-Poulenc plant contractor told the inspector that buried drums were found on Vista's property 2-3 years ago. These drums were found as a result of Rhone-Poulenc using the property temporarily and digging holes to place fence posts. When discovered, the holes were simply filled in and the fence posts placed elsewhere. This is the first information Vista has received on this incident and no knowledge of the drum contents or markings is available at this time.
