In responding to questionnaires such as the one attached to the Sherwin-Williams letter of April 24 requesting
Information on Santocel 68, we should avoid filling out forms which Imply that Monsanto has unique and unchallenge able data to offer. This is particularly true in responding to those questions that contain an element of Judgment. For example, does Rule 66 apply? or under Federal Standard 313 which of the several categories best fits our product?.
I have attached copies of the Product Specification and
Material Safety Data Sheet which relate to Santocel 68. The American Conference of Governmental Industrial Hygienists (ACGIH) has adopted a TLV for silicas of 20 mppcf.
Relating to metalcontent, we have the followings

Your letter dated April 26 was forwarded to me for re sponse since I have been intimately associated with the polychlorinated biphenyl environmental situation.
With increasing evidence that polychlorinated biphenyls were being identified as environmental contaminants and that some mammals, birds and marine life were being
affected, Monsanto began in 1970 a program to terminate the sales of PCBs to those applications for which alterna tive materials were available. The program has now been successfully completed and sales of polychlorinated bi phenyls are restricted to dielectric uses in electrical capacitors and transformers in which the polychlorinated biphenyls are hermetically sealed in metal containers. This application is being continued because there are no known fire resistant fluids which can perform in this service. It is our considered opinion, and also of representatives of governmental regulatory agencies, that the fire resistant benefits derived from this appli cation far outweigh the adverse consequences to the environment in the event of an accidental spill. To further minimize environmental impact the fluids we now market have been modified to eliminate the more persistent isomers, Monsanto's total program is based
on its desire to dramatically reduce further contamina tion of the environment and it is an action which we believe any responsible manufacturer would have taken.

The problem of disposing of solid wastes containing polychlorinated biphenyls continue to plague us. Ideally, disposal should be made by exposing the waste to high temperature Incineration. Unfortunately, we have not been able to locate commercial incinerators capable of reaching the high temperatures required. Additionally, the problem of segregating and collecting the waste material still remains to be solved. Lacking proper Incineration, the only recourse available is the use of authorized, properly-managed dry landfills. It Is our considered opinion that, as long as the polychlorinated biphenyl waste Is not exposed to water and thereby trans ported, adverse effects to the environment will be essen tially eliminated.

I have reviewed the attached Bureau of Engraving and
Imprinting eolitation with Harry Teicher who informs
me that we have been receiving similar documents annually
for many years.

It is Harry's opinion that the specifications for the
material desired are tailored to meet W. R. Grace's Syloid 38. Our current Santocel process cannot produce material which will meet the required properties. I understand samples of our Santocels have been tried by the Bureau of Engraving and Imprinting and have not been acceptable.
It appears that this application is not large enough to Justify any concerted effort to modify our manufacturing process to produce acceptable material.

1972 is attached) and had delayed Implementing pending further clarification of the 0.S. F.D.A. definition of "harmful and deleterious" heat transfer media. The F.D.A. no longer uses the words "harmful and deleterious" in referring to heat transfer fluids which have replaced the FCB types. We are now ready to use the new text.
As you know, we no longer sell PCB type heat transfer fluids.
However, we still believe it is appropriate to caution
the user that heat transfer fluids intended for indirect
heating ehould not contaminate food, feed, pharmaceuticals
or any item which may directly or indirectly be ingested
by humans.

Label 1150/53 was designed to be used with FCB/FCT plasti cizers and heat transfer fluids and contains the words
"DO HOT USE IN ANY SYSTEM INVOLVING PROCESSING OR HANDLING OFs Food or food related products; Food wrapping or con tainer materials; Pharmaceuticals or Animal feed stuff." This wording is not appropriate since the non-PCB heat transfer fluids are used in systems processing and handling
food, feed, etc.

I recommend that your two committees jointly consider appropriate guidelines that would apply to this type of situation and which would he included in the ANSI Committee C-107 aokarel guidelines.

In their memo dated April 6, Claudette Deatherage and John J. Freeman were helpful in focusing on the confusion which seems to exist relating to the determination of the presence of free maleic anhydride and free maleic
acid in our EMA products. It seems to me that resolution of this confusion cannot be made until some basic questions
are answered by appropriate functional groups.
The questions that occur to me and the functional group which I believe Is best prepared to respond are as follows:
1. Marketing --
What are the needs of our customers relating to the presence of free monomers?
2. Research --
Which monomer and In what quantities is most sig nificant in characterizing our product?
3. Process Research --
,
Is the EMA process capable of producing a product which can satisfy 1 and 2 above?
4. Manufacturing --
Can the producing units at Luling and Texas City, following the approved process, produce a product which can meet the monomer require
ments?
I am aware that Shengen Hu, W. M. Haynes and J. W. Jewell are currently reviewing a proposed Polaroid procedure. However, I understand this procedure is Intended to determine the amount of maleic acid present. Will it satisfy our total needs.

I have finally completed a review of the regulations pertaining to trace elements In paints and find the status is as follows:
Under Title 21-CFR-Chapter 1, Subchapter 0, Part 191.9 (a)(6) any paint or other similar surface-coating material intended, or packaged in a form suitable for use in or around the household is declared a hazardous substance and banned frcxa interstate commerce between December 31, 1972 and December 31, 1973 if its lead content exceeds 0.5 percent (5000ppm) of the total weight of the contained solids or dried paint film, Thl3 regulation became effective on April 25, 1972. A proposal to control lead content at 0.06 percent (600ppm) after December 31* 1973 is still under consideration.
A proposed regulation to control antimony, arsenic, cadmium, mercury, selenium at a maximum of 0.05 percent (500ppa) total content end soluble barium at 1 percent of the total barium present i3 still being considered. This proposal would be designated under Title 21-CFRChapter 1, Subchapter D, Part 191.5.
As you know we have no Information on the trace element content of our Lampblacks. I personally would not expect levels which would result in 600ppra or 5000 ppm lead or 500ppm of the remaining elements In dried paint film.
The decision to conduct the necessary analyses to obtain the Information requested by KCD must be made by the Product Group based on commercial consideration.

I reviewed Polaroid's proposed EMA-31 specifications and noted that Appearance, Volatiles, Dichloroethane, Viscosity and Total Maleic are identical to our approved Finished Product Specification dated June, 1972. Percent retained on USSS 14 is shown as 0 maximum compared to our 0.1 maximum. Moisture by CEC analyzer is shown at 0.7 maximum whereas our specification has no moisture requirement.
Can Manufacturing consistently produce EMA-31 which will meet Polaroid's specifications?

You recently requested that I arrange for a meeting during
the week of April 23 to review the status of research activity relating to Polaroid's recommendation that we adopt analytical procedures developed by them. I have some thoughts concerning the role that the product acceptability function assumes in situations of this sort and had intended to discuss this with appropriate individuals within the SCS business group. A series of urgent, high-priority matters have prevented me from conducting these discussions, therefore, I will attempt to share my thoughts with all recipients of this memo
using the Polaroid request as an example.
It seems to me that any request originating with the customer automatically becomes the immediate concern of the marketing function. The field sales and the pro duct group representatives must decide whether the request has merit and what further action appears to be warranted.
In this instance, the Polaroid request was considered worthy of further action.
Since the request related to the evaluation of a pro
posed analytical procedure, it becomes the responsibility
of the research group within SCS. Representatives of
the research function must then establish,after conferences
with marketing representatives, the relative priority
warranted by the request. Whether the study Is conducted
within the SCS research function or is made by some other
group, must, of necessity, be the decision of the SCS
research managers. The scope of the study, the quality
of the data generated, the interpretation of the informa
tion and the resulting conclusions and recommendations
remains the responsibility of SCS research.

The "rumor" that Aroclor 1232, formerly marketed by Monsanto, is a mixture of Aroclor 1221 and Aroclor 1242 is correct. Preparation of the material by direct chlorination of biphenyl on occasion would result in a mixture which contained undlssolved crystals of some of the isomers.
As you know, Monsanto has terminated the pro duction and sale of Aroclor 1232 and no samples of the material are available. Laboratories requiring standards can use Aroclor 1221 and Aroclor 1242 which are still available.

The authority which the U.S.G.S. can exercise in controlling the use of FCBs In off-shore facilities appears to be a very unique situation and no other agency to my knowledge has similar authority.
The E.P.A., which is the appropriate agency to regulate
the use of PCBs in applications similar to the one present .
at Noranda Aluminum, does not have the proper legal basis for banning the use of PCBs. The E.P.A. is looking forward
to the passage of the Toxic Substances Act which will get
them the authority they feel they need. Passage of this
Act is expected during this session of Congress, probably
in 1973.

Without the Act there is no way that I know of that we can stimulate any governmental agency to duplicate the U.S.G.S. action.

The PCBs you observed at the Nanticoke Generating Station are used as insulating fluids in power transformers and were probably available to the Station for adding to a newly installed transformer or for the repair of a damaged transformer.
These fluids, in addition to being good insulating fluids, have the added benefit of also being fire resistant thereby adding immeasurably to the safety of the installation in the event unusual operating conditions result in physical damage to a transformer.
I have enclosed reports which, in my opinion, will give you a good summary of the FCB/environmental problem and will also describe the recommended methods for handling and disposal of these materials. I hope you find these reports informative and useful.

As you know, studies relating to the toxicity of hydrogenated terphenyls have been conducted both by Konsanto and others and have been associated with the various trade names such os HB-40 and Ihertalnol 66.
In responding to customers questions It sometimes becomes difficult to refer to the studies with out divulging the fact that these trademarks are describing the same material. Will your office please provide us with some guidelines in this matter.
It appears to me that we could avoid some of . this embarrassment by conducting future studies using a code designation of some sort. Kay I have your comments.

You will note in these guidelines that the disposal of solid articles contaminated with askarels presents a challenge, primarily because incinerators capable of achieving the high temperatures required are not available. To my knowledge the only alternative available to us at this time is the disposal of these articles by burial in suitable dry sanitary landfills. Monsanto Company does not have the capability for disposal of this type of waste. We can, however, destroy by incinera tion wastes which are returned to our Sauget, Illinois plant In heavy duty steel drums. The charge for this disposal is three cents per pound as received at our disposal site.

I suspect that the information relating to the incinera tion of PCBs which appeared in the Interdepartmental Task Force Report originated with me or someone else within Monsanto. All of the information we have relates to the destruction of the liquid PCB mixtures. Ihe pilot tests were conducted for Monsanto by the John Zink Com pany, P. 0. Box 7388, Tulsa, Oklahoma 74105* telephone
918-747-1371. We encourage anyone interested in the studies to contact Mr. Gene McGill of John Zink Company directly. Our personal experience with the commercial unit we have installed as designed by the John Zink Company has de monstrated to our satisfaction that destruction is taking
place.
We do not have any studies involving the incineration
of the solid PCB mixtures such as Aroclor 1268 to which
Mr. Peters refers in his letter. It appears to me that
if partial destruction has been achieved by the Japanese
and Europeans at temperatures up to l600C, that with
,
some modification of the conditions under which combustion
is occurring, total destruction could conceivably be
achieved.
I hope that my comments above along with any information that Mr. Peters can receive from Mr. McGill proves useful.

The term "askarels" is a generic name used by the electrical industry to describe dielectric fluids which are fire resistant. It is not a Monsanto trademark. Polychlori nated biphenyls which are produced by Monsanto are the key Ingredients in the formulation of askarels. The name Inerteen is a Westinghouse trademark for askarels which contain polychlorinated biphenyls. Askarels are still available for use in capacitors and transformers. Polychlorinated biphenyls have not been banned by the federal government, however, Monsanto, as a principal producer of these materials, voluntarily terminated their use in all applications except as ingre dients in askarels. In response to your request relating to proper handling methods I am enclosing a copy of a NEMA proposal which I believe thoroughly covers the subject.

I have been in recent contact with Fred Klemensic in reference to Monsanto's evaluation of the proposed conducto metric method for the assay of free acid in EMA-31. Ned Page has sent copies of this procedure to Cole Weber in January of this year and Cole has undoubtedly reviewed the method with you.
Fred told me that Monsanto has not as yet tried the method
and we agreed to a cross-sampling plan so that analytical
data could be generated both at Monsanto and Polaroid. Fred
has made arrangements to have samples taken at Texas City,
analyzed there, and duplicate samples sent both to you and me
for analysis. As we just received 25,000 lbs. of EMA-31, I
ha-'e h^d some of the lots sampled here and am sending you one
set and our Analytical group. Dr. Leon Rubio, one sen. This
should provide us with sufficient sampling and data from three,
analytical labs to establish this test and determine if it
could be dene routinely for Polaroid Corporation. The sample

I agree that it is most difficult to conceive of birds or humans "eating" insulation but we are sincerely con cerned about eventual disposal during manufacture and when buildings are eventually demolished.
I assure you that considerable thought has been given to all of the uses in which PCBs could be applied and we have concluded that applica tions such as the one you are proposing can eventually lead to problems, Monsanto Company is not interested in having polychlorinated biphenyls used in such systems.

Attached is a copy of an OECD Decision Of The Council relating to PCB proposals adopted by the Council on February 13, 1973*
The proposal as adopted contains no recommendations or actions which we had not anticipated. Note the continued concern regarding small capacitors (page 6) and the reference to the Japanese ban on small capacitors (page 7).
There is no evidence that the U.S. will condone PCB use in heat transfer systems or in hydraulic fluids for mining applications.

I find Whittaker, Clark & Daniels' request for trace element content of Lampblacks based on PDA requirements confusing. We cannot find the appropriate regulations which refer to trace elements in paints.
Your reference to Title 2l-CFR-Chapter 1, Subchapter D, Part 191 does not apply. Generally trace elements have been considered as potential problems in plant waste ef fluents. The amount of Lampblack used in any paint for mulation is relatively small. The amount of trace ele ments which might be present in the Lampblack would in turn be exceedingly small, resulting in a final mixture which should pose no problems relating to trace elements.

Aroclor 1016 is a mixture of polychlorinated biphenyls which was commercially available during the summer of 1971 and became the preferred dielectric fluid for use in capacitors. Since September 1971 Monsanto terminated the sale of Aroclor 1242 for this application and would supply only Aroclor 1016.
Aroclor 1016 is similar to Aroclor 1242 except that the isomers containing five or more chlorine atoms per biphenyl group have been reduced considerably.
Sales of Aroclor 1016 have been made only to capacitor manufacturers. In 1971 3>33^*000 pounds were sold domestically. In 1972 20,902,000 pounds were sold.

PROPOSAL
A system for handling, shipping and disposing of transformer grade, sample service askarel wastes to provide environmental safety.
Servicing of askarel-containing transformers requires the drawing of repre sentative samples of the fluid. Generally, two to four quarts are obtained from the main drain valve and an additional quart from the sample bottle rinse. The procedure is repeated for a transformer top sample. The waste quantity will vary from one to two gallons per transformer, depending on service company procedure. Integrity of containers presents a problem, as does the possibility of accidental spills during handling. Such spills could result in sewer or ground contamination. In addition, prolonged storage and deterioration of the filled containers could cause leakage and further con tamination. Another potential source of contamination is damage during ship ping. Lack of a simple, efficient disposal system may be the reason for unauthorized disposal of the askarel wastes into rivers and streams.
Standardized containers and collection procedures, a means of solidifying the askarel wastes, and authorized disposal should help eliminate the environ mental threat.
The system we propose is as follows:
Providing a fiberboard carton containing four one-gallon plastic cube containers with appropriate closures and a four-pack fiberboard pre addressed package.
Each cube container will be loaded with a pre-determined quantity of Dow Imbiber Beads, a product that will solidify the waste askarels within minutes.
The outer package is pre-addressed for delivery to an authorized solid wg.ste incinerator or supervised dry land fill site for disposal.
The advantages of the system we propose are:
.. A standard container for disposal.
.. A method for solidifying the askarel wastes to prevent leaks or other accidental contaminating spills.
,. A method of environmentally sound containment when disposed of in dry land fill and assurance that such disposal will be accomplished by authorized personnel and procedures.
.. A product and container that meets the requirements for environmentally sound high temperature incinerator disposal.

I too ara puzzled regarding the origin of the statement that only one in a hundred million ballasts burn out or otherwise fail. I personally am not aware that any one in Monsanto has made that claim. We have relied on information from the electrical industry and have used references such as the General Electric article referred to in your letter. In fact, this General Electric article was the source of our statements which we made before the Interdepartmental Task Force on PCBs in Washington on May 15# 1972. I have enclosed a copy of the full presentation for your use.
I am tempted to speculate that perhaps someone has attempted to distinguish between those capacitor failures that result In electrical malfunction and those capacitor failures which result In a rupture of the capacitor container and immediate release into the environment. This attempt at differentiating between the two types of failures could have resulted in the lower failure rate quoted. I believe representatives of the capacitor industry are In a better position to comment in this area than I am. You may wish to contact Dr. A. Pozefsky, General Electric Company, Hudson Falls, New York. Dr. Pozefsky may be able to give you more precise informa tion relating to ballasts and thermal controls as required by the Manual of National Electrical Code 1971.
We have Ions recognized that disposal of failed small capacitors which are widely distributed Is extremely difficult to control. With this in mind we hove developed a more degradeable version of capacitor PCB fluid. You will note in the attached report that we do not propose that this fluid can be freely discharged in the environment

but we do believe that any of this material which acci dentally escapes control will eventually degrade. It is our considered opinion that, although this is not the ultimate desired solution, it represents a significant step in the proper direction.

I have reviewed some of the current phosphate legisla tion to determine how it might apply to our Dequest for mulations. In every case the legislation refers to deter gents. A typical definition of the term "detergent" reads as follows*
The term detergent means any cleaning compound which is available for household use, laundry use or industrial use, which is composed of organic and inorganic compounds, soaps, water softeners, surface active agents, dispensing agents, foaming agents, buffering agents, builders, fillers, dyes, enzymes and fabric softeners whether in the form of crystals, powders, flakes, bars, liquids, sprays or
any other form.
In every Instance the references to phosphate content
do not make any attempt to describe how the phosphorus
Is present chemically. It would appear that the Dequests
with phosphorus present and used In cleaning compounds
would be affected by these laws.

Summaries of legislation in specific areas are as follows:
Miami - Phosphates In household detergents are banned. The Dade County Pollution Con
trol Hearing Board on April 13> 197? granted an extension to July 1, 1973 exempting mechanical dishwashing compounds and pro ducts used for Industrial and institutional purposes.
Chicago - The City Department of Environmental Control" extended for one year to December 31# 1973 the continued presence of phosphates in mechanical dishwashing compounds and industrial
and institutional products.

Buffalo (Erie County) - Ihe presence of phos phates' In detergenta vias banned on January 1, 1972 but mechanical dishwashing products and Industrial and Institutional uses are exempt.

Indiana - At present phosphates are totally bahned'except for mechanical dishwashing com pounds and industrial and institutional pro ducts which are exempt until April 30, 1973. The State Legislature is currently favorably considering an alternative bill which will restore the limited use of phosphate and elimlnate the April 30 termination date for the exempted uses.
The expression "industrial and institutional uses" includes bottle washing operations.
I have attached a summary of state and local phosphate legislation which I hope you find useful. As you well know, the use of phosphates in detergents continues to be rather emotional and considerable activity remains in the many legislatures and other law-making groups. Because of the degree of activity and the resulting changes in local situations, I recommend that in dis cussions with our customers we avoid giving the impres sion of offering firm legal advice and in every case we should recommend that the customer consult with his legal advisors relating to legislation in those areas in which he intends to market his product.

The Food and Drug Administration, as a natter of policy, does not approve substances by trademark and will only consider chemical, generic or common designations. There fore, they cannot consider approval of our Syton EZ-50 without divulging the presence of Silicon Dioxides and Sorbitol. I can appreciate why we do not wish to divulge these in gredients at this time.
Both Silicon Dioxides and Sorbitol are acceptable by the FDA in paper and paperboard packaging as shown on the attached copies of portions of the regulation. Using this information as a basis, I propose the following statement be considered at this times
SYTON EZ-50 meets federal requirements for use In the manufacture of food packaging under existing food additives regulations.
The ingredients present in SYTON EZ-50 have been granted GRAS status by the Food and Drug Administration and are included in a list of substances migrating to food from paper and paperboard products used in food packaging that are generally recognized as safe (21 CFR 121.101h). The properties of the ingredients which permit acceptability are not altered in any way during its manufacture, therefore, SYTON EZ-50 itself meets the requirements. Additional reference to acceptability may also be found in part 121.2526(a)(2) of the regu lation.
I hope this type of statement will be of some help at this time. Please feel free to reword. If the intent of the statement is altered I would appreciate reviewing your draft.

Our laboratory has not developed methodology for the determination of Thermlnol 66 in food products. Including vegetable oils. I have attached a copy of a letter Paul Gann wrote to the WARP Institute In which he relayed some of our suggestions offered by our R&D people. I suggest that you send similar information in response to your current inquiry. Items one and three are the pertinent sections.
I have also attached two copies of a methodology for determining Thermlnol 66 in water. You may wish to for ward one of these to your customer.
I hope this information is suitable for your current needs. If the customer Insists on a more refined pro cedure I will ask our R&D people to develop methodology. This may take several weeks of a chemist's time and may cost from one to two thousand dollars.

Your question relating to the purity of these Aroclors is difficult to answer because all of these represent mixtures of the various isomers which are formed when biphenyl is chlorinated. The number of isomers in a mixture probably varies from 50 to 80, In any event each mixture is
considered to be 100$polychlorinated biphenyls.
Your question relating to the content of PCB impurities is difficult to answer since I do
not know what is meant by MFCB impuritiesw.
I am attaching a.copy of Monsanto's analytical methodology. In this material you will find chromatographs for each of the Aroclors. These chromatographs denote to the analytical chemist which of the homologs are present in each mixture
and the approximate quantity.

Warren Easley called to inform us that the publication of the pending PDA PCB regulation has been delayed and is now predicted for Karch, 1973.
It appears the American Paper Institute severely criticized the FDA*s environmental impact statement as being invalid and not complying with NEPA guidelines, primarily because no consideration was given to the economic impact of the proposed regulation. The Institute has also threatened legal action If the regulation is published without revi sions to the environmental impact statement.
The PDA Is somewhat confused at this point. Hie impact statement on FCBs in food is the first the Administration has prepared. It looks upon this requirement as a delaying tactic and considers it as being in conflict with its re sponsibilities under the Food, Drug and Cosmetic Act.
The Council on Environmental Quality also commented on the lack of consideration to the economic impact of the pro posed regulation but did so in milder tones, primarily as a reminder that this item must be covered in detail In future FDA environmental impact statements.
Regarding the question of the length of the period for compliance, it appears that only 30 days will be available for corrective action from date of publication to date for compliance. At this time the FDA has not developed any plans for monitoring, inspecting or enforcing the reg ulation. .

IJhis property is not in Monsanto's specification and is not presently measured. Two samples diluted with a 50-50 mixture ROH-K2O to 2 by weight gave pH's of 1.9 at 25C.
Appearance
As manufactured, Monsanto specification designates "straw to dark brown", however, the plant informs me that Inmont's request for water white liquid can be met.
Specific Gravity @ 25C/4C
We cannot meet this requirement. Specific gravity measured at 25C/15.56C has a range of 1.130 1.140. ......

These properties are not in our specifications and are not routinely determined. It appears that Inmont may have copied their proposed levels from our Technical Bulletin 1-120, dated November 1961. I

As I recently discussed with you, the Functional Product Groups Division is considering the possi bility of funding some PCB research now under way at the Ohio Agricultural Research and Development Center, Wooster, Ohio. We were originally approached by the administrator of the Center to participate in a "Grant-In-Aid Agreement" providing for the total funding of the study. I have attached a copy of the Agreement document. Our decision relating to the support of this work was delayed, however, the Center proceeded with the research activities. Recently the program director wrote to me stating that he has exhausted all of his available funds and desires help from Monsanto.
Since the work is already under way, it appears that the "Grant-In-Aid" approach may no longer be appropriate and that partial financial assistance could be provided as a "direct gift". We are considering offering approximately $5,000 toward this study. May we have your recommendation as to the best approach we should follow consistent with appropriate tax considerations.

Kr. Sadowsky Informed me that representatives of the Michigan State Water Resources Commission had determined that PCBs, identified as Aroclor 12^2, were being discharged from the Ford vinyl plant.
We briefly discussed the sources of PCBs, presence in Aroclors, and degradability. He stated that he knew where the PCBs were being discharged and Indicated that conversions of heat transfer systems were either underway or planned. He personally had no information on the replacement fluid avail ability, conversion procedures or disposal plans but offered to discuss these with the proper people in his plant. I gave him your phone number as well as mine and offered our services.

In responding to Howard Bergen*e question "What changes have occurred In enforcement policies or legislation that would affect our strategy?", I believe the most significant legislation that Is relevant was the passage over the President1s veto of the Federal Water Pollution Control Act Amendments of 1972.
I have attached a copy of a comprehensive summary of these Amendments. You will note that they require the achieve ment, by not later than July 1, 1977, of effluent limitstions from point sources which "shall require applica tion of the best practicable control technology currently available as defined by the Administrator." By July 1, 1983 the Amendments require effluent limitations for point sources which "shall require application of the best available technology economically achievable which will result in reasonable further progress toward the national goal of eliminating the discharge of all pollu tants." The Administrator may modify the requirements for 1983 with respect to any point source for which a permit application Is filed after July 1, 1977, upon a showing by the owner or operator of such point source satisfactory to the Administrator that such modified requirements (l) will represent the maximum use of technology within the economic capability of the owner or operator; and (2) will result In reasonable further progress toward the elimination of the discharge of pollutants. Any 1983 limitation shall be reviewed at least every five years and revised if appropriate.
The Amendments include the policy statement that "it Is the national goal that the discharge of pollutants into the navigable waters be eliminated by 1985; it is the national goal that wherever attainable, an interim goal of water quality will be achieved by July 1, 1983; it is the national policy that the discharge of toxic pollutants in toxic amounts be prohibited. The Adminis trator will determine which materials will be defined as toxic as well as the toxic amounts. This list is to be published by mid-year.

At our follow-through meeting held on December 13 I was asked to forward to you any Information resulting from FDA action relating to the PCB levels permissible in converted heat transfer systems in food related processes.
I have attached a copy of the recently issued final environmental impact statement by FDA which contains language that will eventually appear in the FDA regula tions which are to be published on January 20 and be come effective on February 19. You will note that no PCB levels in converted systems are specified. She FDA understands the problem involved in achieving zero detectable levels and has chosen the following words to describe their objectives

Note that the temporary toler ance In paper food packaging material has been set at 10 ppm compared to the 5 ppm originally proposed. Paper food packaging material containing more than 10 ppm PCB may be used if an effective barrier is incorporated In
the food package.
The tolerance for Infant and junior foods has been relaxed from 0.1 ppm originally proposed to 0.2 ppm. Tolerances
for animal feed have been tightened from 0.5 to 0.2 ppm for complete animal feeds and from 5.0 to 2.0 ppm for animal feed components..
Other temporary tolerances remain the same as in the
original proposal. These were: milk and dairy products,
2.5 ppm on a fat basis; poultry, 5.0 ppm on a fat basis;
eggs, 0.5 ppm; fish and shell fish, 5.0 ppm on an edible
portion basis.

Our discussions with FDA representatives relating to PCB residues in flushed heat transfer systems were apparently successful because no PCB limits in flushed systems are indicated. The following more flexible statement has
