Madical Division PROVIDING APPROPRIATE TIMS INTERVAL BETWEEN PHYSICAL EXAMS ON THOSE EMPLOYEES KORKINS WITH CHEMICALS CONTROLLED BY LEGISLATION Under existing legislation, as decreed by Dept. of Labor under the Occupational.Safety and Health Act, those industries who use, handle, manufacture, ete. substances on which definite legislation has been passed and published in the Federal Register must conform to the stated ragulations otherwise said industry is not in compliance with the law. Currently, there exists only 2 instances where this is applicable: (1) asbestos and (2) certain carcinogens. Z am certain your organiza tion is aware of the existence of the documents which describe all the ragulations concerning these substances. However, I wish to bring to your attention the portions which relate to medical care and surveillance, etc. In the documents covering both of these categories, it is clearly stated that there be a comprehensive ennuel physical examination on employees who work with these substances. Until now, it has baen the position of the Du Pont Co. that amployeas age 41 years end above only receive an annual physical exam. Those 40 years end balow ere examined every 2 years. Your work force ie allotted each year a certain grand total of exam times. To be specific, the current medical work force has the capability of examining 121 of your work force on an annual basis. Your area clerk is aware of the number of allotted time intervals allowed each week which oyer a period of 52 woeks yields your 82% coveregs. Who the area clerk- schedules to fill those intervals has never baen the responsibility of the Medical Division. Thus, Z would propose that you give careful consideration to the concept of insuring that those employees whose work brings them under this law be gven first priority for examination on an annual basis.
