Ritter EDF vs. Train Suit At AT Date Copy to March 2, 1977 V * Attached is the latest correspondence from Keller & Heckman re the EDF vs. Train Suit. The important thing to note is that the Department of Justice, EPA and EDF have apparently negotiated a settlement of the suit and are filing a motion to dismiss the suit without prejudice. The basis of this is that the above parties have, apparently, reached a settlement in terms of a renegotiation of the Standard. The most important feature presently believed to be in this settlement is that the existing VCM Standard would be lowered from the present 10 ppm to 5 ppm within'three years from the date of promulgation. The goal of EDF is to have another standard promulgated by the end of this year. Gordie Rozand will discuss with Engineering the implication of such a change immediately. The enclosures attached hereto, which we consider fully self-explanatory, are as follows: (1) A copy of a February 11, 1977 letter from Gary Baise to Don Fowler by means of which Mr. Baise confirmed in writ ing his requests that SPI be permitted to participate in the ongoing Environmental Defense Fund-Environmental Protection Agency "settlement negotiations" in the abovereferenced case. (2) A copy of a February 22, 1977 letter from A1 Beveridge to us in which he discusses the apparent nature of a possible settlement proposal and its timing vis-a-vis the progress of the case proper. \J (3) A copy of a Washington Post article by Gershon Fishbein re1ative to"finding substitutes for hazardous substances, a concept which seems to be getting more attention from the press. (4) A copy of an article from the Newark, New Jersey Star-Ledger which is something of an update on the situation in New Jersey where the Legislature is considering an all-encompassing ban on "cancer-causing agents."
