FIELD PROBLEM AND LITIGATION STATUS REPORT
1. California
a.. Lakewood:
On July 14,1981 the City Council voted (4 to 1) to continue
using A/C pipe. Report of the Interdepartmental Study
Team, "Evaluating the Health Effects of Asbestos Cement
Water Pipe," to be distributed by AACPP. t

Connecticut Departmenit of Health Services
On August 27, 1981, AACPP special counsel withdrew industry's application for a declaratory ruling on the safety of A/C pipe. The rationale for this decision was the hearing panel's reluctance to accept the interim results of the NIEHS animal feeding study. Withdrawal does not prejudice rights to refile the application at a future date.
3. Illinois
a. Salem: 4. Minnesota
CAPCO filed suit against the City for not honoring a low bid to install A/C pipe. A hearing was held on September 1-2, 1981; Staff assisted in presentation of testimony. The court dismissed CAPCO's complaint; no futher action is anticipated.
a. Crookston:
After the bid letting, the consulting engineer changed the specifications for A/C pipe from T70 to T80. FmHA-State concurred with this judgment. FmHA-Washington and regional counsel in Chicago also concurred with the City's attorneys that it could purchase ductile iron pipe under the "contractor's option" bid provisions. No further action is anticipated.
5i Pennsylvania
a. Blairsville:
A citizen's group has protested the use of A/C water pipe in this small community outside Pittsburgh. There has been broadcast media coverage, a special City Council meeting and involvement by health scientists from the University of. Pittsburgh School of Public Health. Johns-Manville is coordinating this field problem.
6. Wisconsin
a. Crivitz:
On August 24, 1981 the court ruled that there were not signficant levels of asbestos fiber in Crivitz's drinking water system. The plaintiff's complaint was dismissed.
b.- Weston:
Johns-Manville has requested AACPP to participate in the pending litigation between it and the City. AACPP counsel will contact J-M counsel and prepare a memorandum outlining defense options.
