The purpose of this meeting is to ask the Department to suspend or rescind its determination that lands proposed to be taken into trust by the Coquille tribe in the state of Oregon will qualify as Indian lands for the purpose of the Indian Gaming Regulatory Act and the regulations appearing 25 CFR Part 292.11. This determination was made as part of the fee to trust process for lands located in Medford, Oregon, which are approximately 140 miles from the tribes existing reservation in Coos County, Oregon. This decision was one of approximately eight Indian gaming decisions made by Acting Assistant Secretary - Indian Affairs Larry Roberts late on January 19, 2017. My client, the Cow Creek Band of Umpqua Tribe of Indians, Oregon, opposes the development of the casino in Medford, and believes the determination by ASIA Roberts and the Solicitor's Office was in error as a matter of both law and policy. I am attaching a letter we sent to the Department addressing this issue on January 20, 2017, along with two additional letters we've submitted to the Department that outline our position. In the meantime, the Office of Indian Gaming may attempt to process the publication of a Federal Register notice making the Draft Environmental Impact Statement for the Coquille Fee to Trust Application for lands in Medford, Oregon, available for public review.
