This inspection report is based on information supplied by conversations with Mr. Reuben Halme, Mr. Kyle Webb, Mr. Cyle Boeck, or direct observations made at the time of the inspection, and records and reports maintained by the permittee and/or general contractor. This inspection report may also include information gathered from a review of EPA, State, and/or public records.
SECTION I - INTRODUCTION
Entry and Inspection Chronology
This was an unannounced inspection; I was joined on the inspection by fellow EPA Region 10 Inspector Emily Siangkam and Washington State Department of Ecology (Ecology) inspector Maria Zeman. At approximately 8:00AM on the day of the inspection, I called and spoke with Mr. Cyle Boeck, Project Manager with HD Fowler Corp. Mr. Boeck is listed on the project's Notice of Intent (NOI) as the current operator/permittee. I introduced myself discussed that I had been asked to conduct an on-site inspection at the HD Fowler SR-3 Industrial Stock Yard construction project to assess compliance with the project's coverage under Ecology's Construction Stormwater General Permit (CGP). I explained that the inspection was in coordination with Ecology and would include a walk-through of the construction site and a review of permit related documents. Mr. Boeck welcomed the inspection and discussed that the site is currently active with the general contractor on-site (Tapani, Inc), likely pouring footings and completing some utility work. Mr. Boeck explained that he would be unable to join on-site, but discussed that general contractor representative, Mr. Kyle Webb of Tapani, Inc. would be on-site and available for the inspection.
Ms. Siangkam (EPA), Ms. Zeman (Ecology) and I arrived on-site at approximately 10:30AM, we entered the jobsite trailer and were greeted by Mr. Reuben Halme, Civil Superintendent with Tapani, Inc. Mr. Webb was also present within the job-site trailer but was initially on the phone at the time of our arrival. Mr. Halme discussed that he had just finished a walk-through that morning with representatives of the local stormwater authority, who had had just departed the site.
Following our initial introductions, I presented my EPA credentials and discussed the purpose and expectations of the inspection and provided my business card. We had a brief discussion regarding the project's general timeline and recent activities, Mr. Halme explained that the project was wrapping up utility work and vertical construction was still in the initial phases. It was discussed that Mr. Halme has been involved on the project since it broke ground in September 2023 (approx.) and Mr. Webb had only been on-site approximately 1 weeks. It was discussed that Mr. Webb is a Certified Erosion and Sediment Control Lead (CESCL); however, the project also utilizes Lissa Rhoades, with Tapani, Inc. for CESCL related work. Ms. Rhoades was not currently on-site. The project's former Assistant Project Manager and CESCL, Mr. David Wessles had left employment approximately 1-week prior to the inspection.
The inspection consisted of an opening conference, a walk-through of the construction site, a records review and concluded with a closing conference. Portions of the record review also occurred post-inspection, as discussed in Section III of this inspection report. During the closing conference we discussed our observations during the walkthrough, potential compliance concerns and next steps. We were accompanied throughout the inspection by Mr. Halme, Mr. Webb was present for portions of the opening and closing conference. Post-inspection, I followed up with an email to Mr. Halme, Mr. Webb and Mr. Boeck recapping the general inspection activities that had occurred, as Mr. Boeck was unable to join on the inspection. I also provided a copy of EPA's Small Business Resources Information Sheet.
Project History
The HD Fowler HR-3 Industrial Stock Yard construction project (hereinafter referred to as the "Project") is permitted to discharge to the Highway-3 Ditch under the CGP, the permit tracking number assigned to the project is (WAR312451). Based upon my review within Ecology's Permitting and Reporting Information System (PARIS), the initial permit application (notice of intent) for the construction project was submitted by Mr. Boeck on April 6, 2024. Permit coverage was effective on May 18, 2023. See Attachment A, Permit Coverage Letter. No prior EPA/Ecology inspection/enforcement activity had been previously documented.

SECTION II - OBSERVATIONS
Site Review
The Project consists of developing an 8.26 acres site, encompassing five separated parcels with a total area of approximately 12.44 acres. The Project includes the construction of a 16,000 square-foot warehouse and a 4,500 square-foot, 3-sided storage building. The site will serve as a warehouse and distribution center for HD Fowler Corp. (permittee), storing waterworks, irrigation and landscape, pumps, and wastewater equipment. The outdoor storage yard will store plastic and iron pipe, pressure tanks, large pipe fittings, plastic septic tanks, stormwater chambers and fire hydrants.
For the construction of the warehouse and distribution center, activities also include adding site access and road improvements along SW Birt Drive, land clearing/grading, utility installation, the construction of permanent stormwater infrastructure, including a collection system (pipes and catch basins) that convey runoff to an engineered stormwater vault and large infiltration/detention pond. See Attachment B, Site Plans. North of the Project is the permitted discharge location, the SR-3 Roadside ditch. Gorst Creek is located downslope of the SR-3 roadside ditch, west of the Project. Gorst Creek discharges to the Sinclair Inlet of the Puget Sound.
At the time of inspection, perimeter silt fencing had been installed, construction/site access had been completed and the area had been cleared and graded and base material (rock) had been applied. The primary/permanent stormwater/sediment pond and associated vault(s) had been constructed. A second, temporary stormwater/sediment pond had also been installed. As discussed earlier in this report, Mr. Halme explained that the project was currently wrapping up the remaining utility work and vertical construction was still in the initial phases. Construction was on-track to be completed in June 2024.
At the time of inspection, approximately 8-9 Tapani, Inc. staff were on-site, the majority appeared to be working on trenching and installing water main piping along SW Birt Drive. Approximately 10 steel/masonry subcontractors were working on initial construction of the warehouse. Mr. Halme discussed that he was currently working on repairing PVC piping used to pump stormwater from the two stormwater ponds to a wooded/vegetated area south of the construction area. The pumping of stormwater allowed the project to route stormwater to the wooded/vegetative area for infiltration, rather than discharge the SR-3 roadside ditch. Mr. Halme discussed that pipe repairs were required after several sections of piping became cracked/damaged after a recent cold weather event which caused the freezing within the above-ground piping. As a result of the broken lines, the stormwater pond was approaching maximum capacity. Mr. Halme was not aware of any discharges from the Project to the SR-3 Roadside ditch from the infiltration/detention pond.
Photographs taken during the inspection walk-through are attached to this inspection report as Attachment C, Photograph Log. Initially for the walk-through we reviewed the Project's Site Map, which was posted on one of the walls inside the job-site trailer (Photo 1 & Photo 2). We departed the job-site trailer and began the walkthrough along SW Birt Drive. We first observed the northern perimeter including the trenching work that was occuring at the time of inspection.
Walk-Through Observations:
Location: SW Birt Drive Observation #: OB-001
We first observed areas north of the job-site trailer, including north and south of SW Birt Drive. Perimeter chainlink fencing was installed around the property, as well as silt fencing along the construction boundary. As a best management practice (BMP), unstabilized areas were generally covered with straw (Photo 3).
Along SW Birt Drive, we observed active trenching and water pipe installation occuring on the north end of SW Birt Drive. The new trench was being dewatered just north of the trench, between SW Birt Drive and SR-3. The trench dewatering water appeared turbid, discharging to a vegetated area off-site near the intersection of SW Birt

Drive and Sunnyslope Road SW, south of SR-3 (Photo 4 & Photo 5). The discharge was not observed downslope of the vegetative area, east of Sunnyslope Road SW (Photo 6 & Photo 7). We returned to SW Birt Drive and continued to observe the flow path of the dewatering discharge and trenching activity (Photo 8 - Photo 12).
Location: Northern Construction Areas Observation #: OB-002
We continued west along SW Birt Drive, until we returned to the northeast corner of the Project. We observed a single catch basin located north of the planned warehouse structure (Photo 13 & Photo 14). Mr. Halme discussed that the single catch basin is the sole catch basin not currently routed/connected to the Project's stormwater vaults/ponds. The single catch basin discharges separately to the SR-3 roadside ditch, northwest of the catch basin. The areas around the catch basin were unstabilized, no inlet protection or stormwater BMPs were observed. Stormwater was observed entering the catch basin as sheet flow from the area(s) west/southwest of the catch basin.
We then walked southwest and observed discharge location for the single catch basin we had just visited. The discharge location was on the north side of the perimeter fencing (Photo 15). A below ground PVC pipe was discharging stormwater to a rip-rapped area into the SR-3 roadside ditch. Accumulated sediment was observed within the rip-rapped area (Photo 16). It was discussed that the outfall/discharge was not being monitored/sampled.
We continued southwest and continued to observe the remaining sections of the northern perimeter. In addition to the applied base rock, silt fencing and straw was being used as BMPs along the northern perimeter (Photo 17). We also observed two catch basins installed (Photo 18); Mr. Halme discussed that both catch basins were routed to the primary/permanent stormwater pond.
Near the northwest perimeter, we came to an area of silt-fencing that had previously failed according to Mr. Halme (Photo 19). Mr. Halme discussed that the area appeared to be a low spot of the northern perimeter, after the silt-fencing failed and was repaired, a temporary drainage pipe was installed to divert stormwater under the newly constructed access road and into a stormwater catch basin that discharges to the primary/permanent stormwater pond (Photo 20 & Photo 21).
We continued southwest and observed the northernmost stormwater vault that receives stormwater from the northern catch basins (Photo 22 & Photo 23). The stormwater vault(s) discharge to the primary/permanent stormwater pond via piping. Mr. Halme discussed that the media for the stormwater vaults had been received and currently staged on-site.
We then observed the primary/permanent stormwater pond located in the northwest corner of the site; the pond was observed to be at or near full capacity (Photo 24). Mr. Halme discussed that the Project was currently unable to pump/dewater the pond to their upper temporary pond and designated dewatering area. This was due to several sections of PVC pipe currently damaged after a recent cold/freeze event.
Mr. Halme discussed that prior to the cold/freeze event, the Project had been routinely pumping from the primary/permanent pond to an upper/temporary pond, most recently one week prior (approx). From the upper/temporary pond, the Project would then dewater via a sediment bag to a wooded area south of the construction area. Dewatering was utilized as an alternative to discharging to the SR-3 road ditch. It was discussed that a gated valve controls the pond's discharge to the SR-3 road ditch and the Project had yet to open the valve to discharge to the SR-3 road ditch.

From the northwest boundary we then traveled south along the western perimeter. We observed the southern areas of the stormwater pond and several sections of broken PVC piping currently in repair (Photo 25). We also observed the southern stormwater vault (Photo 26) and staged media for future use within vault(s) (Photo 27). Along the western perimeter, we observed a section of silt fence in need of maintenance (Photo 28). The adjacent property to the west was an auto wrecking business that was temporarily closed. Construction areas had generally been covered with base rock. As we continued south, we observed the secondary/temporary stormwater pond and dewatering area located within the vegetated/wooded area (Photo 29 - Photo 32).
Location: Eastern Construction Areas Observation #: OB-004
As we returned north from the vegetated wooded area, we walked along the eastern boundary and observed additional catch basins that were connected to the primary/permanent stormwater pond. Catch basins were equipped with fabric filters (Photo 33 & Photo 34), construction areas were generally covered with base rock. Along the eastern perimeter, we also observed a foundation trench that had been excavated and currently full of water. Mr. Halme discussed that the Project had just received the required permitting items for that area, which had been delayed following the trenching activity. The trench had yet to be dewatered and/or connected to the stormwater collection system (Photo 35 - Photo 37).
Location: Central & Northeastern Construction Areas Observation #: OB-005
Within the construction area we observed numerous materials staging areas. Within one staging area, we observed an open 5-gallon bucket labeled "Spraylock SCP 327," as well as a 5-gallon bucket of lubrication oil (Photo 38 - Photo 39). We continued to the active vertical construction areas (Photo 40 & 41), within the area we observed another stormwater catch basin and additional areas where base rock was applied (Photo 42). We also observed the Project's fuel storage area within enclosed shipping containers that were staged on-site (Photo 43). We then entered the job-site trailer to conduct the records review and closing conference.
Location: SR-3 Roadside Ditch & Stormwater Pond Discharge Location Observation #: OB-006
The SR-3 roadside ditch and primary/permanent stormwater pond's discharge location isn't easily accessible from the construction area due to perimeter fencing. At the time of inspection, it was discussed with Mr. Halme that the inspection team would be visiting the area after departing the Project site, following the closing conference. Mr. Halme elected not to join us for this final portion of the inspection.
Upon arriving at the SR-3 roadside ditch and pond outfall along SR-3, we observed water within the stormwater pond's discharge pipe and within the SR-3 roadside ditch. Rip-rap was observed at the pipe's discharge location. Straw wattles within the SR-3 roadside ditch appeared to need maintenance. Stormwater within the SR-3 ditch was observed to be either infiltrating or ponding. No discharge to Gorst Creek was observed (Photo 44 - 48).

The Project's SWPPP was located within the job-site trailer. The SWPPP was prepared by N.L. Olson and Associates, Inc., with a prepared date of August 2022. The SWPPP narrative include the 13 required elements contained with the permit. I suggested updating the SWPPP to include the current CESCL contact information, as Mr. David Wessels had left employment the week prior to the inspection.
Record: SWPPP Site Map Reference #: RR-002
The Project's Site Map was located within the job-site trailer and posted on the wall. The Site Map contained handwritten notes of BMP install dates, locations, and general comments (Photo 1 & Photo 2).
Record: Routine Site Inspection Reports Reference #: RR-003
Routine Site Inspection Reports were not available at the time of inspection. Mr. Halme discussed that site inspection reports are generated electronically following the inspection and sent to Lissa Rhoades of Tapani, Inc., who helps manage CESCL activities. It was believed that the reports were only available to view internally/electronically by Tapani, Inc.
I requested the Project email completed Site Inspection Reports for my review. On January 30, 2024, I received weekly Site Inspection Reports via email from Ms. Rhoades, they were reviewed upon receipt.
Reports received were completed on the following dates: 08/31/23, 09/06/23, 09/14/23, 09/21/23, 09/29/23, 10/05/23, 10/18/23, 10/25/23, 11/03/23, 11/07/23, 11/15/23, 11/30/23, 12/07/23, 12/11/23, 12/20/23, 01/03/24, 01/10/24, 01/18/24, 01/25/24.
It was noted that the first report, dated August 31, 2023, was blank and likely generated in error. Site inspections were initially conducted by Mark Abernathy, who was listed as the Foreman/CESCL for the time. Reports generated by Mr. Abernathy were documented on a 21-page checklist. On October 25, 2023, site inspections transitioned to being conducted by Ms. Rhoades, who utilized a 6-page checklist. On occasion, Ms. Rhoades would also include photographs of site conditions/BMPs. On January 18, 2024, site inspections transitioned to Mr. Webb, utilizing the 21-page checklist.
The November 8, 2023, Site Inspection Report indicated: "water flow to low point across site and blew out silt fence, stopped work repaired silt fence and diverted water to pond stabilized silt on outer edge of silt fence with straw." It was noted within the report that the site had received 4.09 inches of rainfall since the last inspection and 1.35 inches in the past 24-hrs.
The December 7, 2023, the Site Inspection Report was generated by Arthur Lipe, CESCL. The report indicated that a turbidity sample was collected and reported at 60 NTUs.
Record: Discharge Monitoring Reports (DMRs) Reference #: RR-004
At the time of inspection, no DMR's had been submitted for the Project. Post-inspection, DMR's were submitted by Lissa Rhoades on February 6, 2024. DMR's were reviewed on March 18, 2024, using Ecology's Permitting and Reporting Information System (PARIS). Post-Inspection, I reviewed DMR's applicable at the time of inspection (August 2023 - December 2023). The review indicated the DMR's were submitted for each month and indicated "No Discharge." The November 2023 DMR included the following comment: "11/8: ERTS#728372. Fence blew out by the time went to test water team had repaired area and stopped all discharge."

Along SW Birt Drive, we observed active trenching and water pipe installation occuring on the north end of SW Birt Drive. The new trench was being dewatered just north of the trench, between SW Birt Drive and SR-3. The trench dewatering water appeared highly turbid, discharging to a vegetated area off-site near the intersection of SW Birt Drive and Sunnyslope Road SW, south of SR-3 (Photo 4 & Photo 5). The discharge was not observed downslope of the vegetative area, east of Sunnyslope Road SW (Photo 6 & Photo 7). We returned to SW Birt Drive and continued to observe the flow path of the dewatering discharge and trenching activity (Photo 8 - Photo 12).
According to Section F.3. "Utilities" of the Project's SWPPP: "Dewatering devices shall discharge to an appropriate sediment trap or pond, preceded by adequate energy dissipation, prior to runoff leaving the site. If a sediment trip is not used on the site, discharge shall be upstream of a properly installed silt fence."
The concern was the highly turbid dewatering water observed to be discharging off-site without controls.

Permit Condition S4.C.2.a. states: "The permittee must sample all discharge points at least once every calendar week when stormwater (or authorized non-stormwater) discharges from the site or enters any onsite surface waters of the state (for example, a creek running through a site); sampling is not required on sites that disturb less than an acre."
Permit Condition S4.C.3.a. states: "Sampling is required at all points where stormwater associated with construction activity (or authorized non-stormwater) is discharged off-site, including where it enters any onsite surface waters of the state (for example, a creek running through a site."
Permit Condition S9.D.7. states: "Protect all storm drain inlets made operable during construction so that stormwater runoff does not enter the conveyance system without first bing filtered or treated to remove sediment." AOC:

The concerns are that no inlet protection was observed to be installed for the identified catch basin and the discharge from the catch basin to the SR-3 roadside ditch was not being sampled/monitored. Accumulated sediment was observed at the discharge location within the SR-3 roadside ditch.

Permit Condition S9.D.11.a states: "Permitees must maintain and repair all temporary and permanent erosion and sediment control BMPs as needed to assure continued performance of their intended function in accordance with BMP specifications."
The Stormwater Management Manual for Western Washington (July 2019) lists maintenance standards for BMP C233 (Silt Fence) which includes: "Remove sediment deposits when the deposit reaches approximately one-third the height of the silt-fence or install a second silt-fence. AOC:

Permitees must submit monitoring data using Ecology's WQWebDMR web application accessed through Ecology's Water Quality Permitting Portal."

At the time of inspection, no DMR's had been submitted for the Project. Post-inspection, DMR's were submitted by Lissa Rhoades on February 6, 2024. The concern is that August 2023 - December 2023 DMR's were submitted on February 6, 2024, past the 15days following the end of each month requirement. In addition, the December 7, 2023, sampling event documented in the corresponding Site Inspection Report, was not reported in the December 2023 DMR (Attachment E).

Upon arriving at the SR-3 roadside ditch and pond outfall along SR-3, we observed ponded water within the stormwater pond's discharge pipe and within the SR-3 roadside ditch. Stormwater within the SR-3 ditch was observed to be either infiltrating or ponding (Photo 45 & Photo 46).
Earlier during the inspection, it was discussed with Mr. Halme that a gated valve controls the pond's discharge to the SR-3 road ditch and the Project had yet to open the valve to discharge into the SR-3 road ditch.
Although water was not observed to be flowing at the discharge location, the concern is the presence of the ponded water observed within the stormwater pond's discharge pipe and within the SR-3 roadside ditch with the gate valve not having been opened.

Permit Condition S9.D.9.a. states: "Handle and dispose of all pollutants, including waste materials and demolition debris that occur on-site in a manner that does not cause contamination of stormwater."
Permit Condition S9.D.9.b. states: "Provide cover containment, and protection from vandalism for all chemicals, liquid products, petroleum products, and other materials that have a the potential to pose a threat or human health and or the environment." AOC:
Within the construction area we observed numerous materials staging areas. Within one staging area, we observed an open 5-gallon bucket labeled "Spraylock SCP 327," as well as a 5-gallon bucket of lubrication oil (Photo 38 - Photo 39).
The concern is the potential stormwater contamination from the open bucket of "Spraylock SCP 327" and storage location of the bucket of lubrication oil.
SECTION VI - CLOSING CONFERENCE AND POST INSPECTION CORRESPONDENCE
Closing Conference
Following the walk-through of the construction areas, a closing conference was held with Mr. Halme and Mr. Webb. We discussed our general observations and AOC #001-003, & AOC #006. We also discussed the followup records request for the completed Site Inspection Reports.

On January 30, 2024, I received an email from Ms. Rhoades that contained the requested Site Inspection Reports.
