Dear Doctor Machle: Thank you very much for your reports on and I informed you under date of August 27th that I had requested Mr. Mack to send me a number of copies of the booklet "ftRT5 egula4t- 4ionsp* for Handling and Mixing Ethyl Fluid1' as4i*mm4 1iloar 4t* ro\ 4t-Vhi e one you attached to your letter of August 25th for further distribution to our terminals. Under date of September 3rd Mr. Mack informed me that he did not feel these books should be distributed to our people. I quote, herewith, from his letter: "I do not think that it will be necessary for you to have 16 additional copies of "Regulations for Handling and Mixing Ethyl Fluid by means of Tank Car Equipment and Related Activities", inasmuch as these booklets are designed specific ally for those plants where Ethyl fluid is actually blended. We know that your blending plants in Ohio have been supplied with these booklets inasmuch as Mr. Siebenthaler has made personal delivery and at that time discussed with each of your responsible refinery men the contents of the booklet. I think upon reflec tion you will realise that this booklet is designed for blending plants and not for bulk plants where it would serve no additional purpose that the placard mentioned above will not take care of." Personally, I feel as you do that these booklets should b distributed to our large terminals where we have con siderable storage of leaded gasoline, and even though we may never be called upon to mix Ethyl fluid by means of tank car, still other information in the booklet I believe is essential and our terminal people should be made quite familiar with same. You will also note Mr. Mack states that these book lets were distributed by Mr. Siebenthaler who made personal delivery. This is true, but on the other hand, I feel that in asmuch as the people at these terminals who would be called upon 9/7/37 GSulf Erftntng (iTmiqmity NO. 2-, to clean these tanks are employees of the Gulf, instructions should originate from this office, although it is appreciated that any additional follow-up or personal contact made with these people by Mr. Siebenthaler is beneficial and should be continued* Further, I might add that our request for these booklets naturally included distribution throughout the middle western states under the jurisdiction of this office and Mr* Seibenthaler, of course, does not contact any points outside the state of Ohio* You will recall that while we were in Cleveland there was considerable discussion relating to actual wording of instruc tions issued by Mr* Siebenthaler to our Cleveland people, which instructions were supposed to have been somewhat in conflict with the actual written instructions* These statements by the Cleveland people could have been caused by the confusion resulting from the seriousness of the accident or a lack of serious appreciation of the work involved. In any event, the final responsibility for the following of instructions is thrown back in my lap* I am writing you with reference to this matter because your views 3eem to be somewhat in conflict with the above state ments of Mr* Mack, and I feel that it would be to the best interest of all of us if there could be an agreement in this matter of issuing these booklets and other instructions that might be issued, from time to time by the Ethyl Corporation* I am sending a copy of this letter to Mr* Mack and I would appreciate it very much if you would talk with him on this subject and inform mte of your joint conclusion on this matter* For your information, I am attaching, hereto, a copy of a letter with blue print attachment which I have just recently forwarded to all of our plants covered by this office which, as you know, include the states of Ohio, Michigan, Indiana and Illinois. I want to bring to your attention that these instruc tions are, of course, issued by the Gulf Refining Company and any instructions received from the Ethyl Corporation regarding the handling of Ethyl fluid or the cleaning of tanks containing leaded gasoline would be given to our people as instructions received from the Ethyl Corporation which must be followed and adhered to in addition to our own instructions. Johnston's Circular Letter No.' 1844 dated August 11th, 1937 subjected "CLEANING OF ETHYL TANKS - HANDLING ETHYL GASOLINE". Also the writer's Circular Letter No. 1344 dated September 17th, 1936 under the subject "STORAGE TANKS - CLEANING FLUSHING - DRAINING - REPAIRING". We are attaching hereto completely revised set of instructions for cleaning bulk storage tanks. These instructions are in blueprint form and we ask that as soon as they are received you post them in your office or warehouse where they can be readily referred to by any of your employees. We would also suggest that as soon as you receive these instructions you familiarize yourself with them and see to it that all of your employees do likewise. We refer you particularly to the capitalized footnote on the bottom, of the blueprint which reads thus: "NO TANKS ARE TO BE CLEANED UNTIL WRITTEN AUTHORITY IS RECEIVED FROM THE DIVISION OFFICE. TANKS HAVING CONTAINED A LEADED GASOLINE ARE NOT TO BE CLEANED, UNDER ANY CIRCUMSTANCES, UNLESS THE WORK IS SUPERVISED BY DIVISION OFFICE REPRESENTATIVE AS WELL AS A REPRESENTATIVE OF THE ETHYL GASOLINE CORPORATION." By "LEADED GASOLINE" we mean any gasoline that has a tetraethyl lead content. This includes, of course, all "ETHYL" gasolines as well as all "Q'd" gasolines. If, in the future, you have any occasion to feel that one of your bulk storage tanks should be cleaned you'will please refer the mat ter to this office. Keep in mind, however, that you are to refrain from starting to clean a tank until such time as you obtain written authority from us. We are depending on you to see to it that everyone under your jurisdiction understands the above instructions and that you will personally see to it that all of your employees completely famili arize themselves with the attached.
