Introduction The U.S. Environmental Protection Agency ("EPA") issued a Notice of Referral Letter to T.B.P. Properties, LLC regarding the Rosedale Development Site on May 5, 2023, following a referral from the U.S. Army Corps of Engineers, Norfolk District ("Corps"). Following issuance of that letter, a call was held on June 8, 2023, to discuss the matter. Representatives from EPA, T.B.P. Properties, LLC, Virginia Department of Environmental Quality ("VADEQ"), the City of Lynchburg, and Balzer & Associates, Inc were on the call. This inspection was arranged during the call and through subsequent emails. A. Site Identification The Site is located at 1600 Graves Mill Road in Lynchburg, Virginia (the "Site"). According to the City of Lynchburg parcel viewer the Site is approximately 61.9 acres. The Site is also identified in Attachment 1 - Site Map, a figure from the Corps' Preliminary Juridical Determination for the Site, dated August 3, 2021. B. Weather and Environmental Conditions The weather conditions during the inspection were mostly sunny with some haze. According to the Record of Climatological Observations for the Lynchburg Regional Airport station, the high temperature for the day was 84F. No rainfall during the day of the inspection was recorded. The recorded rainfall at the Lynchburg Regional Airport station for the preceding seven-day period before the inspection are displayed in Table 1 below. Inspection Opening Conference Opening conference was held near the entrance to the Site where the inspection attendees parked. Introductions were conducted and a sign-in sheet was prepared for the inspection attendees (see Attachment 2 - Sign-In Sheet). Representatives from EPA, T.B.P. Properties, LLC, VADEQ, the City of Lynchburg, and Balzer & Associates, Inc were present. EPA discussed the objectives for the inspection and documenting the Site. Mr. Cyrus, with T.B.P. Properties, LLC, asked about preparation of a report by EPA. EPA stated that they would be preparing an inspection report following the inspection that would be provided to the inspection Unique Project #: 3E23WW039A Page 3 of 9 CWA Section 404 Inspection 06/29/2023 attendees once it was finalized. Prior to beginning the inspection walkthrough, the inspectors, Ms. Almeter and Mr. George, displayed their credentials to the inspection attendees. EPA has not made a determination on whether the site/facility is a small business. II. Site Activity The Site is a currently an active construction site for a commercial and residential development (see Attachment 3 - Photographic Log; DSCN4695 to DSCN4697). III. Observations Following opening conference, the inspection attendees walked through the Site to the northeast portion of the property. Ongoing construction activity was observed (see Attachment 3 - Photographic Log; DSCN4695 to DSCN4697). Near the northeastern limits of disturbance, the inspection walkthrough approached the upstream end of a stream, Unnamed Tributary 1 (UNT1) (DSCN4701). Earthmoving activity occurred in the area of UNT1 and a steeply sloped, unvegetated fill pile ran along the right descending bank (DSCN4700 and DSCN4701). Concrete abutments were observed to have been constructed at the base of the fill slope and along the limits of disturbance (DSCN4702; DSCN4704; DSCN4705). Silt fence was also present along the concrete abutments. UNT1 was observed between the two concrete abutments in a channel that contained significant sediment. Mr. Cyrus stated that the silt fence was installed prior to construction activity. UNT1 was observed to have flow originating from a groundwater seep with the presence of iron oxidizing bacteria (DSCN4702; DSCN4719). Saturated, fine sediment was observed in the stream channel (DSCN4705; DSCN4710; DSCN4713; DSCN4714; DSCN4723; DSCN4732). A soil boring was taken in the bed of the channel of UNT1 near the western end of the concrete abutments (DSCN4707). Approximately 11 inches of sediment were observed in the profile above natural surface (DSCN4709). The soil profile was described as a mixed matrix with a silty sand texture consisting of 80% 7.5YR3/3 and 20% 2.5YR4/6 with small rocks present in the profile approximately 0.5 inched to 1.75 inches in size. In the soil profile below 11 inches the soil was described as 75% 7.5YR6/1 with 10% 7.5YR6/6, 10% 5YR5/6 redoximorphic concentrations and 5% 5YR2.5/2 redoximorphic concentrations. Soils displayed a depleted matrix. The water table was present above the surface of the boring with a depth of water in above the surface approximately 1.5 inches. A VADEQ representative took a measurement in a different section of the channel and measured 6 inches of sediment near the thalweg. Unique Project #: 3E23WW039A Page 4 of 9 CWA Section 404 Inspection 06/29/2023 The bed and banks of the active channel were exposed (i.e., primarily unvegetated) and consisting of dirt with exposed roots, including roots from woody vegetation. Seeping of water with iron was observed from the current active banks of the channel was observed (DSCN4710). Volunteer herbaceous vegetation was present in patches. Patches of concrete were also observed (DSCN4713). In places the channel was clogged with the sediment and flow appeared restricted relative to the active channel width (DSCN4716 and DSCN4717). Flow appeared to be braided flow pathways or diffuse throughout the accumulated sediment within the channel. In part of the channel flow measured approximately 5 inches wide (DSCN4716), whereas, the active channel, including the accumulated saturated, fine sediment was approximately 53 inches wide (DSCN4717). Approximately 75 feet downstream from the start of the concrete abutments, flow and seeping of water with iron-oxidizing bacteria was observed undercutting the abutment on the left descending bank (DSCN4719; DSCN4722; DSCN4723). On the other side between the concrete abutment and the northern limits of disturbance, a seep and pooling water, algae were observed (DSCN4726). Excess concrete and boulders were also observed (DSCN4720; DSCN4721; DSCN4725; DSCN4728). Soil boring 2 was conducted where there was the presence of 0.5 inches of standing water. In the soil profile, rocks were present through the profile measuring approximately 0.5 to 1.5 inches and the profile was described as 0-9 inches of 7.5YR4/4 saturated sandy fill with refusal at 9 inches (DSCN4727). The inspection walkthrough continued east, downstream along UNT1 toward its confluence with Tomahawk Creek. Approximately 10 inches of sediment were measured in the stream channel (DSCN4732). A headcut, approximately 25 inches in depth, was observed (DSCN4733). As the Inspectors continued to walk downstream, UNT1 became wider and flow was present, but the active channel primarily contained saturated, fine- sediment (DSCN4738 and DSCN4739). PVC pipe perpendicular to UNT1 was observed (DSCN4735). Mr. Cyrus stated that it was preexisting pipe. A constructed stormwater control was documented near UNT1 (DSCN4737 and DSCN4753). Further downstream and outside of the limits of disturbance, UNT1 was observed. The undisturbed width of the stream was 39 inches (DSCN4745). Active flow was present, but bars of saturated fine sediment were present along both banks (DSCN4746). The confluence of UNT1 with Tomahawk Creek was observed (DSCN4748 and DSCN4749). A sediment bar was observed in Tomahawk Creek at the confluence. After walking back within the limits of disturbance from the confluence, Ms. Almeter asked to check the map that Mr. Goodman (Balzer & Associates, Inc.) was carrying and asked about the large wetland complex adjacent to Tomahawk Creek that was mapped. Mr. Goodman verified that the wetland complex was just to the south in relation to where they were standing. Ms. Almeter asked if the inspection walkthrough could go that direction and see the area. Mr. Cyrus agreed and indicated that we could walk that way on our way to get to the stream in the front of the site. He then said that we should let the other folks (i.e., representatives from VADEQ and the City of Lynchburg) know that we were going that direction since they were standing near UNT1 and we wouldn't need to walk back past them if we were going south. Unique Project #: 3E23WW039A Page 5 of 9 CWA Section 404 Inspection 06/29/2023 The inspection walkthrough continued south along a flatter bench of material in the fill pile along the eastern side of the Site (DSCN4755). On the downslope end, where the wetland and stream were mapped on the plan set, the silt fence was visible (DSCN4756). The EPA Inspectors observed a number of areas where the fence was lying on the ground, covered with dirt or sediment and/or rocks, including boulders (DSCN4758 to DSCN4763). Sediment was also observed beyond the silt fence (DSCN4756 and DSCN4757). The EPA inspectors asked Mr. Goodman where the mapped wetland boundary was relative to the silt fence. Mr. Goodman said that the fence was within the limits of disturbance and there was still another 20 to 30 feet from the edge of the limits of disturbance to the edge of the wetland and referenced the flagging that was in the tree line. Mr. Cyrus stated that while he recognizes that the sediment fence had not been maintained in places no material had made it to the wetland. The EPA inspectors walked down the hillslope to observe and verify. The walkthrough included the limits of disturbance, demarked by the blue flagging, through the mapped wetland area and to Tomahawk Creek (DSCN4764 to DSCN4779). A continuous path of sediment was observed toward and into Tomahawk Creek, which was turbid. Approximately 4.5 inches of sediment above natural ground surface was observed in the mapped wetland aera (DSCN4767). The walkthrough continued back up the hillslope to where Mr. Cyrus and Mr. Goodman were standing. Mr. Cyrus asked about the scope of EPA's inspection. He stated that he thought that area was outside the scope of what was covered and that in his mind the inspection was over. Mr. Cyrus' statement to terminate the inspection occurred at approximately 9:36am. Ms. Almeter asked if access to the Site was being denied at that time and for EPA to leave the Site. Mr. Cyrus stated that yes that believed that EPA should leave. Ms. Almeter stated that if that was the case that EPA would want Mr. Cyrus to add a statement to the Sign-In Sheet to that effect, including the time that he asked EPA to leave, and sign the statement. Mr. Cyrus did not move to do that but went on to say that EPA was on-site per their [the companies'] invitation and that he thought that area was not within the scope of the inspection. Ms. Almeter responded that EPA had requested to do a site inspection and under the authority of Clean Water Act. Section 404 of the Clean Water Act covers aquatic resources, including streams and wetlands. EPA was there to observe the aquatic resources on the Site and those were aquatic resources on the Site. Following with "isn't that correct?". Mr. Goodman acknowledged that it was accurate. Mr. Cyrus said that the area was not one that VADEQ had previously looked at and that his understanding was that EPA had "only been referred the two streams identified in the letter from the Corps". Ms. Almeter stated that EPA was not limited to what VADEQ had previously inspected. VADEQ had different authorities and EPA was there to inspect under Section 404 of the Clean Water Act. Ms. Almeter also said that the Corps referred the Site to EPA and that this was within the Site boundary and there are aquatic resources here. Mr. Cyrus then stated that EPA should have asked before going there. Ms. Almeter reminded Mr. Cyrus that EPA did ask to observe this area prior to the inspection walkthrough going to that part of the Site. Mr. Goodman acknowledged that EPA had made that request. Mr. Cyrus asked about what EPA saw down there. Ms. Almeter showed Mr. Cyrus and Mr. Unique Project #: 3E23WW039A Page 6 of 9 CWA Section 404 Inspection 06/29/2023 Goodman the photographs from that portion of the inspection walkthrough. Mr. Goodman stated that those photos show what "I would expect based on how the slope looks up here". Mr. Cyrus then asked for EPA to agree to limit the remainder of the inspection to only the other stream area. Ms. Almeter countered with "how about if there are other areas that EPA wants to observe I will ask, and we can discuss them at that time?". Mr. Cyrus agreed that it was acceptable. Ms. Almeteralso stated that "I will continue to take photos of other areas along the way that I want to document, if that is acceptable?". Mr. Cyrus said that "it seems like you assume you have the authority and have made up your mind, so it doesn't matter what I say". Ms. Almeter responded that "I asked the question that I asked". The discussion regarding access concluded at approximately 9:42am. Mr. Cyrus started walking to the next area and the inspection walkthrough resumed. The inspection walkthrough continued near the limits of disturbance to the south and west towards the side of the property near Graves Mill Road where the arch culvert had been constructed (DSCN4795 to DSCN4798). Mr. Goodman indicated that the mapped wetland area abutting UNT2 was fenced with orange plastic fencing (DSCN4797). The EPA Inspectors observed the upstream portion of UNT2 before it flowed into the culvert. UNT2 was observed to be flowing and had an Ordinary High Water Mark and bed and banks (DSCN4799 and DSCN800). Flow at a depth of approximately 5 inches was present in the channel upstream of the culvert. Upstream of the culvert in an undisturbed portion of the stream, the width of the stream channel was 23 inches (DSCN4801). Near the limits of disturbance (at the fence) the channel of UNT2 was 33 inches wide. The Inspector observed aquatic macroinvertebrates instream during a short visual survey (i.e., midge larva and water penny larva). Vegetation was present along the banks and riparian zone, including woody vegetation. UNT2 flows from west to east along the south end of the property near Graves Mill Road. A soil boring was taken in the area between the stream channel and the retaining wall (outside of the orange fencing) (DSCN4805 and DSCN4806). Soil boring 3 is described. From 0-4 inches soils were 2.5YR 4/6 sandy fill. At 4 inches the natural surface was observed, and vegetation remains were present. From 4-7 inches soils were 100% 10YR4/2. From 7-9.5 inches soils were 85% 10YR4/2, 10% 2.5YR4/4 redoximorphic concentrations and 5% 10YR6/3 depletions. From 9.5-12 inches soils were 70% 10YR4/2, 15% 10YR6/3, and 15% 2.5YR4/4 redoximorphic concentrations. From 12-21+ inches soils were 90% Gley 1 6/10y and 10% 10YR6/8. Vegetation around the soil boring included deertongue (Dichanthelium clandestinum), arrowhead (Sagittaria latifolia), jewelweed (Impatiens capensis), and woolgrass (Scirpus cyperinus). The EPA Inspectors observed the upstream end of the arch culvert. The arch culvert sits on two concrete abutments. As UNT2 flows towards the culvert the flow bends around the southern concrete abutment (i.e., the side closest to Graves Mill Road) (DSCN4811 to DSCN4813). Seeps and surface saturation was observed along the northern concrete abutment (DSCN4808). At the upstream end of the culvert concrete, gravel and black plastic were observed in the stream bed (DSCN4816). Within the culvert the banks and edges of the active channel of UNT2 were exposed with very little vegetation present. The bed of the channel was primarily finegrained (silts and sands). At the immediate upstream end of the culvert, the channel of UNT2 was 36 inches wide (DSCN4817). Mr. Cyrus stated that the culvert construction began in the summer of 2021 and was approximately 660 feet in length. Mr. Cyrus checked his construction schedule and confirmed that the culvert was constructed by late March 2022. The Inspectors observed UNT2 within the arch culvert (DSCN4819 to DSCN4851). For the upstream portion within the culvert an actively flowing channel was present. The edges of the channel were flat, generally saturated, and mainly exposed dirt (DSCN4819 and DSCN4827). Woody roots were present and a couple of individual standing dead woody stems were observed (DSCN4821, DSCN4824, and DSCN4837). The water table was observed in gaps along the concrete abutments (DSCN4822, DSCN4823, and DSCN4826). Within the culvert, the banks and sides of the channel consisted of uneven piles of dirt with many exposed woody roots (DSCN4830 and DSCN4834). Within the culvert the channel of UNT2 measured 13 inches wide (DSCN4831). Approximately mid-way within the culvert, the active channel flowed toward and under a concrete abutment (DSCN4839 to DSCN4851). For the remainder of the culverted area there was no observable surface stream channel (DSCN4843 and DSCN4844). The EPA Inspectors asked Mr. Cyrus about the presence and location of the barn that the U.S. Army Corps of Engineers had refenced in their discussions with EPA. Mr. Cyrus indicated that there had been a barn, which was constructed in the 1980s, that used to be present in the southern portion of the Site, not far from the UNT2 area. Mr. Cyrus pointed out the location to the inspector (DSCN4852). The walkthrough concluded back at the area where the cars were parked. IV. Records Review A review of Site or facility records was not a component of the inspection; therefore, EPA is not expecting to access business records, including confidential business information ("CBI"). If the Site or facility owner wants to make a CBI claim on information or photographs collected by the inspector during the inspection, they can submit a claim to EPA. After the Site or facility representative notifies EPA of the CBI, EPA representatives will mark the CBI as such, and it will be handled as CBI according to EPA's procedures. V. Closing Conference A. Overview Closing conference was conducted near the areas where the inspection attendees had parked after concluding the inspection walkthrough. Mr. Cyrus asked about the next steps and timeline for EPA's inspection report and any other next steps. EPA's inspection report would be Unique Project #: 3E23WW039A Page 8 of 9 CWA Section 404 Inspection 06/29/2023 finalized within 60 days. VADEQ representative stated that their inspection report would likely be finalized and transmitted within a few weeks. Mr. Goodman asked about any information that EPA would be looking for. EPA said that they were in the process of preparing a request. B. Observations Relayed to Site Representative No specific observations were relayed to the representative at closing conference. The inspector indicated that following the finalization of the inspection report EPA would likely request to set up a call to discuss the Site. VI.
