As part of the surface mining process, many historic treatment ponds are present at the Site. It is located east of Old Flomaton Road and adjacent to Big Escambia Creek (Attachment A). The majority of the Site is located in Escambia County, Florida, and approximately 20 of the 200 acres cross state lines into Escambia County, Alabama. Purpose and Need for Discharge of Dredged and/or Fill Material N/A Site Overview (Past inspections, site description, permits, etc.) The Florida Department of Environmental Protection (FDEP) inspected the Site on January 19, 2018, January 15, 2020, and May 24-25, 2022. After each inspection, FDEP staff informed the facility representative(s) present at the time of these inspections, as well as their engineer, that the Department had no record of a Notice of Intent to Mine or an Environmental Resource Permit (ERP) Effective August 2020 Page 2 of 5 Clean Water Act Section 404: Site Visit/Case Develoment For inspections authorized pursuant to Clean Water Act sections 308 and 404 (33 U.S.C. 1318 and 1344) Site Name Campbell Sand & Gravel Co. - Big Escambia Mine (North) Start Date December 6, 2022 End Date December 6, 2022 for the mine footprint on file for disturbances after October 1, 2017 - the date when the ERP came into effect in Northwest Florida. The facility was issued a five-year continuance of their General Permit (FLA413101-008-IWF/GC) by FDEP that became effective on October 6, 2015. On August 15, 2022, FDEP sent Campbell Sand & Gravel a Warning Letter for Big Escambia North Mine that requested that the facility contact the Department for a meeting. No previous inspections conducted by the Alabama Department of Environmental Management are known. However, the latest reissuance NOI application for NPDES General Permit No. ALG850116 was submitted on December 30, 2021, yet withdrawn. There are no known 404 permits from the Army Corps of Engineers issued for the Site. Work carried out at the Site consists of mechanical land clearing and pond excavation in a wetland system, construction of roads in a wetland system, material sorting, and construction of drainage ditches in a wetland system. Analysis of rainfall data from the National Oceanic and Atmospheric Administration's daily global historical climatology network indicated that antecedent precipitation for the Site 90 days prior to the inspection was normal, although an incipient drought was noted in November 2022 (see Attachment B). Field Work Conducted Observations of data points were conducted throughout the Site and their locations were recorded using a GPS-enabled Nikon AW120 camera and a Trimble Geo7X (submeter accuracy GPS unit). Photographs were taken of field observations. The Regional Supplement to the U.S. Army Corps of Engineers Wetland Delineation Manual: Atlantic and Gulf Coastal Plain (Version 2.0), in addition to the 1987 Corps of Engineers Wetland Delineation Manual, were utilized during the inspection as a reference for the field observations. Locations of observations are included in the attached photographic log (Attachment C). Closing Conference Documents Received and/or Requested During the Inspection None. Observations Relayed to Site Owner/Operator Mr. Sims was informed by the EPA team that we would discuss our observations with management, and that the EPA inspection report would be released to Campbell Sand & Gravel within 70 days of the closing conference. The appropriate state staff are to be included on the electronic release. Actions Taken by Owner/Operator During the Inspection (If any) None. Potential Issues of Concern Including Regulatory Citations Unauthorized discharged of dredged and/or fill material into wetlands and tributaries (Sections 301 and 401 of the CWA, 33 U.S.C 1311 and 1344). EPA CWA 404 team observed mechanical land clearing and pond excavation in a forested wetland system, construction of roads in a wetland system, construction of drainage ditches in a wetland system, and the commingling of treatment water with a wetland system.
