KENNEOfe^tfsjtklGELES MEMORANDUM FOR ALL PAINT AND COATINGS MANUFACTURERS IN THE CHICAGO AREA SUBJECT: Restrictions on Uses of Lead and Other Heavy Metals in Paints and Proposed Chicago Ordinances igs 1. Two proposed ordinances relating to the use of lead and certain other heavy metals in paints and coatings presently are pending before the Chicago City Council. These proposals are unreason ably restrictive, unnecessary and impractical. If they should be adopted, as presently worded, it is believed that both industry compliance and enforcement would be impossible. Chaotic conditions would prevail, which would impact not only on the manufacturers of paints and coatings, but also on painting contractors, painters, dealers, homeowners and even the city government of Chicago. 2. The attached "Bulletin" amplifies this matter to alert you to the seriousness of the problem. To assist in explaining the industry's position and all other relevant facts on these unreasonable pro posals, we have prepared an Analysis of the ordinances. We urge you to read the Bulletin and the Analysis carefully. 3. Again, I stress that this is a crisis for our industry and -- your help is urgently needed! It is imperative that you submit written comment on this ordinance to the Buildings and Zoning Committee, Chicago City Council. Names and addresses of all members of the Chicago City Council are en closed and the members of the Buildings and Zoning Committee have been identified by asterisk. Also, if at all possible please be, or have a representative, at the hearing 1 (Details on this are given in the attached Bulletin.) 4. For your additional information, copies of both ordinances are enclosed. Also, we have provided copies of the Association's comments to FDA on their proposed regulation on this subject and the "Ryan" petition, as well as our comments to the Bureau of Community Environmental Management, Department of Health, Education and Welfare, on the regulations proposed to implement Title IV of the Federal Lead-Based Paint Poisoning Prevention Act of 1970 (P.L. 91-695).
