Introduction Terrace at Maplewood is a currently under-construction, residential development in Harrisburg, PA managed by Burkentine Property Management and owned by Terraces at Maplewood LLC. On May 23, 2024, the U.S. Environmental Protection Agency ("EPA") conducted a joint inspection for compliance with Sections 402 and 404 of the Clean Water Act ("CWA"). This was a targeted inspection and was coordinated with the U.S. Army Corps of Engineers, Baltimore District, the Pennsylvania Department of Environmental Protection, and Dauphin County Conservation District. The observations included in this inspection report pertain only to Section 404 of the Clean Water Act. The work for this project was federally authorized via the United States Army Corps of Engineers, Baltimore District under NAB-2010-00025 Regional General Permit (PASPGP5). A. Site Identification The Site is located on Elmwood Drive near the intersection of Route 39 and N Progress Avenue in Harrisburg, PA. The approximate coordinates of the Site are 40.3237, -76.8505 and is identified in Attachment 1 - Site Map. The road names used in the inspection report for the residential construction project are consistent with the mapping on the Dauphin County's website geo-spatial mapping tool. B. Weather and Environmental Conditions The weather conditions during the inspection were partly cloudy. According to the National Oceanic & Atmospheric Administration's Record of Climatological Observations for the MiddletownHarrisburg Area, PA station, the high temperature for the day was 82F. A total of 0.04 inches of rain was recorded prior to the inspection on May 23, 2024. The recorded rainfall at the MiddletownHarrisburg Area, PA station for the preceding seven-day period before the inspection are displayed in Table 1 below. Inspection Opening Conference Opening conference was held near a site trailer on Hickorywood Lane where activity was currently on-going. Introductions were conducted, the EPA inspectors displayed their credentials to the site representative, Philip Kauffman of Burkentine Builders. EPA explained that the purpose of the inspection was to document conditions of aquatic resources on site. Attendees of the inspection walkthrough included Laura Mathew and Katelyn Almeter of EPA's CWA Section 404 enforcement DSB-ID #: ECAD-5477 Page 3 of 5 CWA Section 404 Inspection 05/23/2025 program, Chuck Schadel of the EPA's CWA Section 402 enforcement program, Scott Williamson of the Pennsylvania Department of Environmental Protection, Alexandra Whittingham of the Dauphin County Conservation District, and Philip Kauffman of Burkentine Builders. EPA has not made a determination on whether the site/facility is a small business. II. Site Activity The Site is currently within an active construction site for a residential development (Attachment 2 - Photographic Log; DSCN5367 and DSCN5368). III. Observations Following opening conference, the inspection began at the northern end of the Site on Elmwood Drive near Hickorywood Lane. The inspectors observed a culvert under Elmwood Drive that had concentrated water flowing into it at the time of the inspection (DSCN5369 and DSCN5370). The slopes of the drainage area upstream of the culvert were densely vegetated and silt socks were present on each of the slopes (DSCN5371). Garbage was noted near the entrance of the culvert (DSCN5372 to DSCN5374). The inspectors observed that no water was flowing out of the culvert and the area immediately downstream of the culvert contained sediment and was sparsely vegetated (DSCN5375 and DSCN5376). Following the drainage path downstream, areas more densely vegetated with herbaceous vegetation followed by areas with woody vegetation were observed (DSCN5377 and DSCN5379). Surface hydrology was observed again in this location. The inspection continued south on Elmwood Drive. A stormwater retention pond was observed to the west of Elmwood Drive that appears to be capturing runoff from the road (DSCN5380 to DSCN5382). A silt fence and cattails (Typha latifolia) were observed in the stormwater retention pond. Continuing south on Elmwood Drive, the inspectors observed a low-lying, linear wetland area between two rows of townhouses (DSCN5383 and DSCN5385). Surface water was observed and the area was densely vegetated with herbaceous vegetation (DSCN5384). The inspection moved back north along Elmwood Drive towards Hickorywood Lane and continued into the vegetated area west of Elmwood Drive across from Maplewood Circle moved to the west in the vegetated area to the south of the active construction area. A soil boring was conducted at approximately 40.32405, -76.85174, the soil was observed to be saturated and a high water table was present (DSCN5387). The soil profile had a depleted matrix and redoximorphic features were observed. The area was densely vegetated with herbaceous vegetation. Woody vegetation was also observed in the vicinity of the soil boring (DSCN5388). The inspectors continued to the west and noted that the area was densely vegetated. A constructed stormwater pond and manhole were observed in the vicinity (DSCN5389 and DSCN5390). The inspectors observed areas with sparser vegetative coverage in areas of exposed earthen material and crushed rock. The inspectors conducted a second soil boring at 40.323235, -76.852487 and observed fill material from 0 to 6 inches above a matrix that was characterized as 7.5YR 4/2 with 15% DSB-ID #: ECAD-5477 Page 4 of 5 CWA Section 404 Inspection 05/23/2025 5YR 4/6 redoximorphic features (DSCN5391 and DSCN5392). The soils met the hydric soil indicator of F3: depleted matrix. Soils were saturated with a high water table present. Herbaceous vegetation observed in this area included multiple species of sedges (Carex sp.), Rice Cutgrass (Leersia oryzoides), Switchgrass (Panicum virgatum), (foxtail (Alopecurus sp.), and soft rush (Juncus effusus). The inspection continued north along the western perimeter of the Site and then east along the northern perimeter of the Site. No additional aquatic resources were observed. The inspection terminated on Elmwood Drive at the intersection of Pinewood Lane. IV. Records Review A review of Site or facility records was not a component of the inspection; therefore, EPA is not expecting to access business records, including confidential business information ("CBI"). If the Site or facility owner wants to make a CBI claim on information or photographs collected by the inspector during the inspection, they can submit a claim to EPA. After the Site or facility representative notifies EPA of the CBI, EPA representatives will mark the CBI as such, and it will be handled as CBI according to EPA's procedures. V. Closing Conference A. Overview Closing conference was conducted near the intersection of Pinewood Lane and Elmwood Drive after concluding the inspection walkthrough. At this time, EPA had no follow up questions or points of discussion regarding aquatic resources on the Site. B. Observations Relayed to Site Representative The EPA relayed that an inspection report including observations and photographs pertaining to Section 404 of the Clean Water Act documented today would be completed and disseminated within 60 days.
