Carcinogens TENTATIVE LIST OF CARCINOGENS ISSUED; OSHA SEEKS PUBLIC COMMENT ON PRIORITIES A list released by the Occupational Safety and Health Ad ministration July 14 tentatively identified 269 substances as Category I carcinogens under an OSHA-proposed regulatory scheme. The list was being sent to more than 430 participants in the rulemaking proceedings being conducted by OSHA on the proposed generic policy for regulating carcinogens. The list is in the Full Text section of this Current Report. Grover Wrenn, OSHA director of health standards, said in releasing the list that OSHA was seeking comment from the participants on setting priorities for regulating the different substances once a policy has been established. "It is in this area that the list can be most helpful,'' Wrenn said. "It may provide a basis for a more substantive discus sion of the issue of priority development, and I encourage all participants to propose a system of priorities for regulation of these substances and to explain the criteria they would use," Wrenn stated. The comments should be made in the form of post-hearing submissions to the cancer policy rulemaking, he suggested. The list was compiled after a preliminary review and categorization of the approximately 2,000 substances con tained in the "Suspected Carcinogens" inventory, 1976 edi tion, of the National Institute for Occupational Safety and Health. In addition to the 269 substances tentatively identified for Category I, the review found 218 substances for possible in clusion in Category II ("suspected" carcinogens) and another 396 substances which appeared to fit Category III (substances deserving more study). Clement Associates, a Washington, D.C., consulting firm, compiled the lists for OSHA under contract. Claim* DIprov*n The tentative selection of 269 substances demonstrates the falsity of claims that "OSHA would regulate all chemicals," according to the agency's announcement. In fact, only 116 of the 269 substances are produced in significant amounts and therefore warrant being considered for regulation at the out set, the announcement said. Clement Associates arrived at the figure of 269 from the Environmental Protection Agency's candidate list under the Toxic Substances Control Act. But the list of 116 substances was derived from production data of the U.S. International Trade Commission (USITC). That data led Clement Associates to identify tentatively 72 possible Category II substances and 181 Category III substances. The list based on USITC data, according to the contractor, "probably provides a more accurate list of chemicals in domestic production than the EPA Candidate List does, but it is limited to organic substances." For inorganic sub stances the EPA list was used, Clement Associates said. Wrenn said OSHA had not yet "scientifically scrutinized" the list and cautioned that the final policy which OSHA adopts could have different criteria for classification than those proposed. OSHA spokesman James Foster said the agency had given "no thought" to using the list in enforcement, adding that the contractor-prepared list lacked "legal sanction." Foster also said no special effort was under way in the health stan dards development office at OSHA as a result of the list. A number of substances on the list -- benzene, dibromochloropropane, arsenic, asbestos -- already are regulated by OSHA standards. According to Wrenn, as OSHA continues to review NIOSH data on suspected carcinogens, substances may be added to or deleted from the list. Data Sourcas U*ad Clement Associates said that, in line with its assignment from OSHA, the firm reviewed only substances in the NIOSH subfile. Thus, National Cancer Institute bioassays were not used as a source, even though the classification of sub stances like heptachlor, heptachlor epoxide, and acrylonitrile, may change as the result of recently published bioassays. Exhaustive literature searches were not performed in the classification of each substance, Clement Associates said, as OSHA had instructed. The chief sources used were articles cited in the NIOSH "Registry of Toxic Effects of Chemical Substances" as describing carcinogenic or neoplastic effects; U.S. Public Health Service "Survey of Compounds Which Have Been Tested for Carcinogenic Activity" 1960-1973; CANCERLINE data base 1973-1977, and the International Agency for Research on Cancer. No attempt was made to use negative studies or the results of short-term testing in the classifications, the contractor said. NIOSH, working independently of Clement Associates and as preparation for participation in the OSHA hearings, com piled its own list of substances which appeared to meet the criteria for carcinogens under the proposal (Current Report, July 14, p. 55). Industry labeled OSHA's list "an unfortunate step backward." The American Industrial Health Council said, if implemented as worded, the policy could result in the ban ning of nickel, which is a needed nutrient, and in chlorine, a water purifier. "Even grilling hamburgers could be restricted," AIHC said in a statement July 14. The group urged that exhaustive literature review and analysis by ex perts be followed before identifying a substance as a poten tial human carcinogen. Pesticides NIOSH CRITERIA DOCUMENT ISSUED, CALLS FOR ADOPTION OF SOME NEW LIMITS A criteria document concerning formulation and manufac ture of pesticides recommends continued use of federal stan dards now in force and adoption of new exposure limits where those standards conflict with other National Institute for Occupational Safety and Health criteria. The NIOSH document, transmitted to the Labor Depart ment July 17, is considered a major step in adoption of a federal policy for dealing with pesticides in the workplace. NIOSH and the Occupational Safety and Health Administra tion are working toward issuance of an OSHA generic pesticides policy (Current Report, May 19, p. 269).
