Mr. William F. X. Geoghan* Jr., Speiser, Shumate* Geoghan and Law 290 Madison Avenue New York 17* New York
Dear Mr. Geoghan:
I am sending herewith the account of my expenses in connection with my participation in your recent case at law. Z also include a bill for my services* on the basis of two days spent in con sultation* preparation and testifying. Inasmuch as this is a modest bill* I think I should explain* lest Z be misunderstood* that I do not participate as an expert witness in any case on any other basis than that of making a charge which will reimburse the Kettering Laboratory for my time so spent. I cannot afford to have any question raised* on the witness stand or elsewhere* as to my concern about fees. This may sound somewhat quixotic, but I am involved-at times in controversies in which the public interest is involved* and* in addition* my testimony is sought from time to time in cases in which I do not wish to appear. 1 undertake to keep this matter entirely free of financial con siderations. This is doubly important at this time when the damages awarded to successful litigants are (in my view) fantasti cally extravagant. Incidentally* when a case as lack in any merit as was this one* can be settled for $200,000, there is something radically wrong with the procedure. I realize* of course* that the expense of various kinds was considerable* and that this had to be covered adequately in the settlement. The price, however* was much too high* and this is one of the reasons that our courts are clogged with trivia.
i
I am returning all of the records which you supplied.to me* for they are of no value to me and they may be to you.
*Let me remind you that I "loaned" you a copy of the Harben Lectures with the expectation that it would be returned when it had served its purpose.
May I say* despite a certain asperity which entered into my remarks above* that it was a pleasure to meet and be associated with you in this action.
Cordially yours,
RAK:ss
