This is just a short note to confirm the report given to you by Jerry Heckman and Dan Dixler on last week's meeting at FDA concerning our pro posal on the jurisdictional issue relative to PVC potable water pipe.
As I'm sure Jerry advised you, present at the meeting for FDA were Dr. Angelotti and Mr. Ronk. In addition to Jerry and Dan Dixler, I, too, attended the conference.
The conference was informal, friendly, and went pretty much as anticipated. We left the meeting with the feeling that the odds against convincing EPA to take jurisdiction, on the basis of the intelligence given us by FDA, are still substantially less than 50-50. In this regard, it is clear that, unless EPA pursues jurisdiction rather vigorously, there is little chance that FDA will cede its responsibility. Accordingly, in conjunction with associate counsel on EPA matters, we are now moving ahead to arrange a meeting with EPA staff to continue the dialogue and, hopefully, that meeting will be held some time next week upon Jerry Heckman's return from Europe.

For the information of all concerned, the written presentation which we prepared for the meeting was reviewed by Dr. Angelotti and Mr. Ronk who offered some minor suggestions but felt, other wise, that the presentation was quite on point. At the conclusion of our meeting, the draft given to Dr. Angelotti was returned to us so that it is not now in the hands of any FDA staffer and cannot, in any way, be deemed to have been filed or otherwise be part of the official record in the proceedings before FDA.
Needless to say, we shall continue to keep you and all those on the De Facto PPI/Uni-Bell VCM Committee fully up to date on developments in this matter including a report on our forthcoming meeting with the EPA staff.
